I came across something quite relevant that needs to be repeated, particularly for those who may be new to this stuff about the so-called law (albeit man-made), that having or carrying a «vehicle-title» is NOT proof of ownership of what is termed «your» car. It is in fact, NOT «your» car, according to the very «Legal-Document» itself !

 

In case it is not CLEAR enough, I am including a scan of the BACK of a State of Washington Vehicle-Title, complete with a GIANT RED BOX out-lining the relevant text... this is probably the same with houses. You «paid off» what you think is «your» house or car ? And now you believe (falsely) that you «own» said house or car ? You might want to think again and actually READ those documents...

The District of Columbia is a municipal corporation, having a right to sue and be sued, and is subject to the ordinary rules that govern the law of procedure between private persons.

The Maryland statute of limitations of 1715, which is in force in the District of Columbia, embraces municipal corporations.

The sovereign power of the District of Columbia is lodged in the government of the United States, and not in the corporation of the District.

This Court expresses no opinion upon the question whether, when the right of property in highways and public places is vested in a municipality, an assertion of that right against purprestures or public nuisances is subject to the law of limitations.

An action by a municipal corporation to recover from a street railroad company the cost of maintaining pavements in a street which the company is by its charter bound to maintain is not an action upon the statute, but one in assumpsit.

De term heeft geen betrekking op het Koninkrijk der Nederlanden of de respectieve overheden van andere landen van het Koninkrijk (Aruba, Curaçao en Sint Maarten). De Staat der Nederlanden draagt niettemin rechten en plichten voor de behartiging van de belangen van het Koninkrijk der Nederlanden en een minister is ook in de hoedanigheid van minister van het Koninkrijk bevoegd de Staat te vertegenwoordigen.

District of Columbia

The District of Columbia is not a state, it is a federal district. When the Constitution of the United States was adopted in 1787, what is now the District of Columbia was a part of the state of Maryland. In 1791, the District was ceded to the federal government for the purpose of becoming the nation's capital, a district that was to be governed by Congress.

How is DC Different than a State?

The 10th Amendment of the U.S. Constitution specifies that all powers not granted to the federal government are reserved for the states and the people.

 

Although the District of Columbia has its own municipal government, it receives funding from the federal government and relies on directives from Congress to approve its laws and budget. DC residents have only had the right to vote for the President since 1964 and for the Mayor and city council members since 1973. Unlike states who can appoint their own local judges, the President appoints judges for the District Court. Residents (approximately 600,000 people) of the District of Columbia pay full federal and local taxes but lack full democratic representation in the U.S. Senate or the U.S. House of Representatives. Representation in Congress is limited to a non-voting delegate to the House of Representatives and a shadow Senator. In recent years, District residents have been seeking Statehood to gain full voting rights.

History of the Establishment of the District of Columbia

Between 1776 and 1800, Congress met in several different locations.  The Constitution did not select a specific site for the location of the permanent seat of the federal government.

 

Establishing a federal district was a controversial issue that divided Americans for many years. On July 16, 1790, Congress passed the Residence Act, a law that permitted President George Washington to select a location for the nation’s capital and to appoint three commissioners to oversee its development. Washington selected a ten square mile area of land from property in Maryland and Virginia that lay on both sides of the Potomac River. In 1791, Washington appointed Thomas Johnson, Daniel Carroll, and David Stuart to supervise the planning, design, and acquisition of property in the federal district. The commissioners named the city “Washington” to honor the President.

In 1791, the President appointed Pierre Charles L'Enfant, a French-born American architect and civil engineer, to devise a plan for the new city.  The city's layout, a grid centered on the United States Capitol, was set at the top of a hill bounded by the Potomac River, the Eastern Branch (now named the Anacostia River) and Rock Creek.Numbered streets running north-south and east-west formed a grid. Wider diagonal "grand avenues" named after the states of the union crossed the grid. Where these "grand avenues" crossed each other, open spaces in circles and plazas were named after notable Americans.

 

The seat of government was moved to the new city in 1800.  The District of Columbia and unincorporated rural areas of District were governed by a 3-member Board of Commissioners. In 1802, Congress abolished the Board of Commissioners, incorporated Washington City, and established a limited self- government with a mayor appointed by the President and an elected twelve-member city council. In 1878, Congress passed the Organic Act providing for 3 Presidentially-appointed commissioners, payment of half of the District's annual budget with Congressional approval and any contract over $1,000 for public works. Congress passed the District of Columbia Self-Government and Governmental Reorganization Act in 1973 establishing the current system for an elected mayor and a 13-member Council with legislative authority with restrictions that can be vetoed by Congress.

MR. JUSTICE BRADLEY delivered the opinion of the Court.

This was an action brought by the District of Columbia in November, 1880, to recover from the Metropolitan Railroad Company the sum of $161,622.52. The alleged cause of action was work done and materials furnished by the plaintiff in paving certain streets and avenues in the City of Washington at various times in the years 1871, 1872, 1873, 1874, and 1875, upon and in consequence of the neglect of the defendant to do said work and furnish said materials in accordance with its duty, as prescribed by its charter.

The defendant was chartered by an Act of Congress dated July 1, 1864, and amended March 3, 1865. By these acts, it was authorized to construct and operate lines or routes of double-track railways in designated streets and avenues in Washington and Georgetown. The first section of the charter contains the following proviso: "Provided that the use and maintenance of the said road shall be subject to the municipal regulations of the City of Washington within its corporate limits." Of course, this provision reserves police control over the road and its operations on the part of the authorities of the city. The fourth section of the charter declares

"that the said corporation hereby created shall be bound to keep said tracks, and for the space of two feet beyond the outer rail thereof, and also the space between the tracks at all times well paved and in good order, without expense to the United States or to the City of Washington."

The fifth section declares

"That nothing in this act shall prevent the government at any time, at their option, from altering the grade or otherwise improving all avenues and streets occupied by said roads, or the City of Washington from so altering or improving such streets and avenues, and the sewerage thereof, as may be under their respective authority and control, and in such event it shall be the duty of said

company to change their said railroad so as to conform to such grade and pavement."

It is on these provisions that the claim of the city is based.

The amended declaration sets out in great detail the grading and paving which were done in various streets and avenues along and adjoining the tracks of the defendant, and which, it is averred, should have been done by the defendant under the provisions of its charter, but which the defendant neglected and refused to do.

The defendant filed twelve several pleas to the action, the eleventh and twelfth being pleas of the statute of limitations. Issue was taken upon all the pleas except these two, and they were demurred to. The court sustained the demurrer, and the cause was tried on the other issues, and a verdict found for the plaintiff. The case is brought here by writ of error, which brings up for consideration a bill of exceptions taken at the trial, and the ruling upon the demurrer to the pleas of the statute of limitations. It is conceded that if the court below erred in sustaining that demurrer, the judgment must be reversed. That question will therefore be first considered.

It is contended by the plaintiff that it (the District of Columbia) is not amenable to the statute of limitations for three reasons: first because of its dignity as partaking of the sovereign power of government; secondly because it is not embraced in the terms of the statute of limitations in force in the District; and thirdly because if the general words of the statute are sufficiently broad to include the District, still municipal corporations, unless specially mentioned, are not subject to the statute.

1. The first question therefore will be whether the District of Columbia is or is not a municipal body merely, or whether it has such a sovereign character, or is so identified with or representative of the sovereignty of the United States as to be entitled to the prerogatives and exemptions of sovereignty.

In order to a better understanding of the subject under consideration, it will be proper to take a brief survey of the government of the District and the changes it has undergone since its first organization.

Prior to 1871, the local government of the District of Columbia, on the east side of the Potomac, had been divided between the corporations of Washington and Georgetown and the Levy Court of the County of Washington. Georgetown had been incorporated by the Legislature of Maryland as early as 1789 (Davis, Laws Dist.Col. 478), as Alexandria had been, by the Legislature of Virginia, as early as 1748 and 1779 (Davis, Laws Dist.Col. 533, 541), and those towns or cities were clearly nothing more than ordinary municipal corporations, with the usual powers of such corporations. When the government of the United States took possession of the District in December, 1800, it was divided by Congress into two counties, that of Alexandria on the west side of the Potomac, and that of Washington on the east side, and the laws of Virginia were continued over the former, and the laws of Maryland over the latter, and a court called the "Circuit Court of the District of Columbia" was established, with general jurisdiction, civil and criminal, to hold sessions alternately in each county; but the corporate rights of the Cities of Alexandria and Georgetown, and of all other corporate bodies, were expressly left unimpaired except as related to judicial powers. See Act of Feb. 27, 1801, 2 Stat. 103. A supplementary act passed a few days later gave to the circuit court certain administrative powers, the same as those vested in the county and levy courts of Virginia and Maryland, respectively, and it was declared that the magistrates to be appointed should be a board of commissioners within their respective counties and have the same powers and perform the same duties as the levy courts of Maryland. These powers related to the construction and repair of roads, bridges, ferries, the care of the poor, etc. Act of March 3, 1801, 2 Stat. 115. On May 3, 1802, an act was passed to incorporate the City of Washington. 2 Stat. 195. It invested the mayor and common council (the latter being elected by the white male inhabitants) with all the usual powers of municipal bodies, such as the power to pass bylaws and ordinances; powers of administration, regulation, and taxation; among others, specially named, the power

"to erect and

repair bridges, to keep in repair all necessary streets, avenues, drains, and sewers, and to pass regulations necessary for the preservation of the same, agreeably to the plan of the said city."

Various amendments from time to time were made to this charter, and additional powers were conferred. A general revision of it was made by act of Congress passed May 15, 1820. 3 Stat. 583. A further revision was made, and additional powers were given, by the Act of May 17, 1848, 9 Stat. 223, but nothing to change the essential character of the corporation. The powers of the levy court extended more particularly to the country, outside of the cities, but also to some matters in the cities common to the whole county. It was reorganized and its powers and duties more specifically defined in the Acts of July 1, 1812, 2 Stat. 771, and of March 3, 1863, 12 Stat. 799. By the last act, the members of the court were to be nine in number, and to be appointed by the President and Senate. In the first year of the war, August 6, 1861, 12 Stat. 320, an act was passed "to create a metropolitan police district of the District of Columbia, and to establish a police therefor." The police had previously been appointed and regulated by the Mayor and Common Council of Washington, but it was now deemed important that it should be under the control of the government. The act provided for the appointment of five commissioners by the President and Senate, who, together with the Mayors of Washington and Georgetown, were to form the Board of Police for the District, and this board was invested with extraordinary powers of surveillance and guardianship of the peace. This general review of the form of government which prevailed in the District of Columbia and City of Washington prior to 1871 is sufficient to show that it was strictly municipal in its character, and that the government of the United States, except so far as the protection of its own public buildings and property was concerned, took no part in the local government, any more than any state government interferes with the municipal administration of its cities. The officers

of the departments, even the President himself, exercised no local authority in city affairs. It is true, in consequence of the large property interests of the United States in Washington, in the public parks and buildings, the government always made some contribution to the finances of the city, but the residue was raised by taxing the inhabitants of the city and District just as the inhabitants of all municipal bodies are taxed.

In 1871 an important modification was made in the form of the District government. A legislature was established, with all the apparatus of a distinct government. By the Act of February 21st of that year, entitled "An act to provide a government for the District of Columbia," 16 Stat. 419, it was enacted (§ 1) that all that part of the Territory of the United States included within the limits of the District of Columbia be created into a government by the name of the "District of Columbia," by which name it was constituted "a body corporate for municipal purposes," with power to make contracts, sue and be sued, and "to exercise all other powers of a municipal corporation not inconsistent with the Constitution and laws of the United States." A governor and legislature were created, also a board of public works; the latter to consist of the governor, as its president, and four other persons, to be appointed by the President and Senate. To this board was given the control and repair of the streets, avenues, alleys, and sewers of the City of Washington, and all other works which might be entrusted to their charge by the legislative assembly or Congress. They were empowered to disburse the moneys raised for the improvement of streets, avenues, alleys, and sewers, and roads and bridges, and to assess upon adjoining property, specially benefited thereby, a reasonable proportion of the cost, not exceeding one-third. The acts of this board were held to be binding on the municipality of the District in Barnes v. District of Columbia, 91 U. S. 540. It was regarded as a mere branch of the District government, though appointed by the President and not subject to the control of the District authorities. This constitution lasted until June 20, 1874, when an act

was passed entitled "An act for the government of the District of Columbia, and for other purposes." 18 Stat. 116. By this act, the government established by the act of 1871 was abolished, and the President, by and with the advice and consent of the Senate, was authorized to appoint a commission, consisting of three persons, to exercise the power and authority then vested in the governor and board of public works, except as afterwards limited by the act. By a subsequent act, approved June 11, 1878, 20 Stat. 102, it was enacted that the District of Columbia should "remain and continue a municipal corporation," as provided in § 2 of the Revised Statutes relating to said District, and the appointment of commissioners was provided for, to have and to exercise similar powers given to the commissioners appointed under the act of 1874. All rights of action and suits for and against the District were expressly preserved in statu quo.

Under these different changes, the administration of the affairs of the District of Columbia and City of Washington has gone on in much the same way, except a change in the depositaries of power, and in the extent and number of powers conferred upon them. Legislative powers have now ceased, and the municipal government is confined to mere administration. The identity of corporate existence is continued, and all actions and suits for and against the District are preserved unaffected by the changes that have occurred.

In view of these laws, the counsel of the plaintiff contend that the government of the District of Columbia is a department of the United States government, and that the corporation is a mere name, and not a person, in the sense of the law, distinct from the government itself. We cannot assent to this view. It is contrary to the express language of the statutes. That language is that the District shall "remain and continue a municipal corporation" with all rights of action and suits for and against it. If it were a department of the government, how could it be sued? Can the Treasury Department be sued? or any other department? We are of opinion that the corporate capacity and corporate liabilities

of the District of Columbia remain as before, and that its character as a mere municipal corporation has not been changed. The mode of appointing its officers does not abrogate its character as a municipal body politic. We do not suppose that it is necessary to a municipal government, or to municipal responsibility, that the officers should be elected by the people. Local self-government is undoubtedly desirable where there are not forcible reasons against its exercise. But it is not required by any inexorable principle. All municipal governments are but agencies of the superior power of the state or government by which they are constituted, and are invested with only such subordinate powers of local legislation and control as the superior legislature sees fit to confer upon them. The form of those agencies and the mode of appointing officials to execute them are matters of legislative discretion. Commissioners are not unfrequently appointed by the legislature or executive of a state for the administration of municipal affairs, or some portion thereof, sometimes temporarily, sometimes permanently. It may be demanded by motives of expediency or the exigencies of the situation -- by the boldness of corruption, the absence of public order and security, or the necessity of high executive ability in dealing with particular populations. Such unusual constitutions do not release the people from the duty of obedience or from taxation, or the municipal body from those liabilities to which such bodies are ordinarily subject. Protection of life and property are enjoyed, perhaps, in greater degree than they could be in such cases under elective magistracies, and the government of the whole people is preserved in the legislative representation of the state or general government. "Nor can it in principle," said Mr. Justice Hunt in the Barnes case,

"be of the slightest consequence by what means these several officers are placed in their position, whether they are elected by the people of the municipality or appointed by the President or a governor. The people are the recognized source of all authority, state and municipal, and to this authority it must come at last, whether immediately or by a circuitous process."

One argument of the plaintiff's counsel in this connection is that the District of Columbia is a separate state, or sovereignty, according to the definition of writers on public law, being a distinct political society. This position is assented to by Chief Justice Marshall, speaking for this Court, in the case of Hepburn v. Ellzey, 2 Cranch 445, 6 U. S. 452, where the question was whether a citizen of the District could sue in the circuit courts of the United States as a citizen of a state. The court did not deny that the District of Columbia is a state in the sense of being a distinct political community, but held that the word "state" in the Constitution, where it extends the judicial power to cases between citizens of the several "states," refers to the states of the union. It is undoubtedly true that the District of Columbia is a separate political community in a certain sense, and in that sense may be called a state; but the sovereign power of this qualified state is not lodged in the corporation of the District of Columbia, but in the government of the United States. Its supreme legislative body is Congress. The subordinate legislative powers of a municipal character, which have been or may be lodged in the city corporations or in the District corporation, do not make those bodies sovereign. Crimes committed in the District are not crimes against the District, but against the United States. Therefore, while the District may in a sense be called a state, it is such in a very qualified sense. No more than this was meant by Chief Justice Taney when, in Bank of Alexandria v. Dyer, 14 Pet. 141, 39 U. S. 146, he spoke of the District of Columbia as being formed by the acts of Congress into one separate political community, and of the two counties composing it (Washington and Alexandria) as resembling different counties in the same state, by reason whereof it was held that parties residing in one county could not be said to be "beyond the seas," or in a different jurisdiction, in reference to the other county, though the two counties were subject to different laws.

We are clearly of opinion that the plaintiff is a municipal corporation, having a right to sue and be sued, and subject to the ordinary rules that govern the law of procedure between private persons.

2. But the Supreme Court of the District supposes that municipal corporations are not embraced in the words of the statute of limitations. Let us see whether that view can be maintained. The statute in force in the District is that of Maryland, passed in 1715, c. 23. The act, as regards personal actions, is substantially the same as that of 21 James I. It commences with a preamble, as follows:

"Forasmuch as nothing can be more effectual to the peace and tranquility of this province than the quieting the estates of the inhabitants thereof, and for the effecting of which no better measures can be taken than a limitation of time for the commencing of such actions as in the several and respective courts within this province are brought from the time of the cause of such actions accruing."

It is then enacted

"that all actions of trespass quare clausum fregit, all actions of trespass, detinue, sur trover, or replevin, . . . all actions of account, contract, debt, book, or upon the case, . . . all actions of debt for lending, or contract without specialty, . . . shall be sued or brought by any person or persons within this province, . . . shall be commenced or sued within the time and limitation hereafter expressed, and not after; that is to say, the said actions of account, and the said actions upon the case, upon simple contract, . . . and the said actions for debt, detinue, and replevin, . . . within three years ensuing the cause of such action, and not after. . . ."

There is nothing in any part of the act to restrain the generality of this language: "All [enumerated] actions sued or brought by any person or persons within this province . . . shall be commenced within three years." Corporations are "persons" in the law. There is no apparent reason why they should not be included in the statute. It is conceded that private corporations are included. On what ground, then, can municipal corporations be excluded? Not on the ground that they are not "persons," for that would exclude private corporations. They are therefore within the terms of the law.

3. Are they not also within the spirit and reason of the law?

They are certainly within the reason of the preamble. It is just as much for the public interest and tranquility that municipal corporations should be limited in the time of bringing suits as that individuals or private corporations should be. The reason stated in the preamble for the passage of the law applies to all, and, moreover, it shows that the objects of the law are beneficent ones, and therefore that it should be liberally construed. It cannot apply to the sovereign power, of course. No restrictive laws apply to the sovereign unless so expressed. And especially no laws affecting a right on the ground of neglect or laches, because neglect and laches cannot be imputed to him. And it matters not whether the sovereign be an individual monarch, or a republic or state. The principle applies to all sovereigns. The reason usually assigned for this prerogative is that the sovereign is not answerable for the delinquencies of his agents. But whatever the true reason may be, such is the general law -- such the universal law except where it is expressly waived. The privilege, however, is a prerogative one, and cannot be challenged by any person inferior to the sovereign, whether that person be natural or corporate.

It is scarcely necessary to discuss further the question of the applicability of the statute of limitations to a purely municipal corporation when it is embraced within the general terms of the law. It was expressly decided to be applicable in the cases of Kennebunkport v. Smith, 22 Me. 445; Cincinnati v. First Presbyterian Church, 8 Ohio, 299; Cincinnati v. Evans, 5 Ohio St. 594; St. Charles Co. v. Powell, 22 Mo. 525; Armstrong v. Dalton, 4 Dev. 569, and other cases cited in the notes to Wood on Limitations § 53, and to 2 Dillon on Municipal Corporations § 668. Judge Dillon, in the section last cited, accurately says:

"The doctrine is well understood that to the sovereign power the maxim 'nullum tempus occurrit regi' applies, and that the United States and the several states are not, without express words, bound by statutes of limitation. Although municipal corporations are considered as public agencies, exercising in behalf of the state public duties, there are many cases which

hold that such corporations are not exempt from the operation of limitation statutes, but that such statutes at least as respects all real and personal actions, run in favor of and against these corporations in the same manner and to the same extent as against natural persons."

In Evans v. Erie County, 66 Penn.St. 222, 228, Sharswood, J., says:

"That the statute of limitations runs against a county or other municipal corporation we think cannot be doubted. The prerogative is that of the sovereign alone; nullum tempus occurrit reipublicae. (Er is geen tijd om het algemeen welzijn te voldoen.) Her grantees, though artificial bodies created by her, are in the same category with natural persons."

See also Dundee Harbour v. Dougall, 1 Macqueen H.L.Cas. 317. But we forbear to quote further authorities on the subject. We hold the doctrine to be well settled.

What may be the rule in regard to purprestures and public nuisances, by encroachments upon the high ways and other public places, it is not necessary to determine. They are generally offenses against the sovereign power itself, and, as such, no length of time can protect them. Where the right of property in such places is vested in the municipality, an assertion of that right may or may not be subject to the law of limitations. We express no opinion on that point, since it may be affected by considerations which are not involved in the present case.

The court below, in its opinion on the demurrer, suggests another ground, having relation to the form of the action, on which it is supposed that the plea of the statute of limitations in this case is untenable. It is this: that the action is founded on a statute, and that the statute of limitations does not apply to actions founded on statutes or other records or specialties, but only to such as are founded on simple contract or on tort. We think, however, that the court is in error in supposing that the present action is founded on the statute. It is an action on the case upon an implied assumpsit arising out of the defendant's breach of a duty imposed by statute, and the required performance of that duty by the plaintiff in consequence. This raised an implied obligation on the part of the defendant to reimburse and pay to the plaintiff the moneys

expended in that behalf. The action is founded on this implied obligation, and not on the statute, and is really an action of assumpsit. The fact that the duty which the defendant failed to perform was a statutory one does not make the action one upon the statute. The action is clearly one of those described in the statute of limitations. The case of Carrol v. Green,92 U. S. 509, is strongly in point. That was a bill against stockholders of an insolvent bank to enforce their liability for double the amount of their stock, according to the provisions of the charter. It was held by this Court that the liability of the stockholders arose from their acceptance of the charter, and their implied promise to fulfill its requirements, and that the legal remedy to enforce it was an action on the case, to which the statute of limitations would apply, and hence that it applied to a bill in equity founded on the same obligation. To the same effect is the case of Beatty's Administrators v. Burnes' Administrators, 8 Cranch 98, where an action for money had and received was brought, under the Maryland act of 1791, against a party who had received from the United States payment for land situated in the District, which land was claimed by the plaintiff to belong to him. This Court held that inasmuch as the form of the action was covered by the statute of limitations of Maryland, it could be pleaded in bar, notwithstanding the action was given by the statute of 1791. So in McCluny v. Silliman, 3 Pet. 270, 28 U. S. 277, it was held that the statute of limitations of Ohio was pleadable to an action on the case brought against a receiver of the land office to recover damages for his refusing to enter the plaintiff's application in the books of his office for certain lands in his district. It was contended that such a case could not have been contemplated by the legislature; but the court held that the action was within the terms of the statute, and that this was sufficient. Many more cases might be cited to the same point, but it is wholly unnecessary.

The judgment must be reversed and the cause remanded with directions to enter judgment for the defendant on the demurrer to the pleas of the statute of limitations, and it is so ordered.

An act or a statute is not a law. It is only given the force of law by the consent of the governed

The Law of the Land = Common Law (no harm, loss, damage or mischief in contracts)

Statutes/Acts = Legislative rule of society given the force of law by CONSENT of the governed (Blacks Law Dictionary),

So does this mean for example,
I get pulled for not wearing a seat belt I can refuse to sign any paper work (contract with an officer),
as I do not consent to Statutes being used against me?

 

As for the consent part, it's a mass consent as in a consent by the people, not the person. In other words, you can't as an individual simply decide that you don't consent and therefore aren't affected, it would have to be a mass decision by country that would affect all, not just you.

Besluiten in strijd met een reglement, of met wettelijke of statutaire bepalingen die het tot stand komen van besluiten regelen zijn niet nietig, maar vernietigbaar (2:15 BW).

Statuten – Conclusie

Statuten zijn erg belangrijk binnen een rechtspersoon. Om de juridische situatie in een specifiek geval rondom de werkzaamheid van een rechtspersoon correct te kunnen beoordelen, is het daarom vaak van belang om de statuten door te lezen en deze naast de wet te leggen. Pas met zowel wet als statuten in de hand, kan er een goede inschatting worden gemaakt.

Het vennootschapsrecht is complex, dat is goed te zien aan de wettelijke regelingen en de hoeveelheid uitzonderingen die gemaakt kunnen worden in de statuten. Komt u er zelf niet helemaal uit, dan kan een goede jurist een oplossing voor uw probleem bieden of u simpelweg van een betrouwbaar advies met betrekking tot de statuten voorzien.

WIE OF WAT IS DE NEDERLANDSE STAAT?

Wat leren we daarover op school?

De Nederlandse Staat is een democratische monarchie. Meerderjarige burgers hebben stemrecht en kunnen de volksvertegenwoordiging kiezen. Dat klinkt toch mooi, niet waar?

 

Maar wat zijn de feiten:

De Nederlandse Staat staat al sinds 1848 ingeschreven als bedrijf in het handelsregister van de USA.

Inschrijving van de Nederlandse Staat in het register van Dun & Bradstreet in de USA. Als dochterfirma's staan alle "publieke" diensten, zoals ministeries, politie, belastingdienst, CJIB etc ingeschreven.
 
Diegene die de wetten maken, zijn niet degene die door het volk worden gekozen. Zij worden door het staatshoofd aangesteld. De volksvertegenwoordiging mag alleen instemmen.
Ons wordt voorgehouden, dat het staatshoofd alleen een formele functie heeft, als vertegenwoordiger van het Nederlandse volk. Hij of zij laat zich echter wel inwijden/kronen door de paus (de hoogste authoriteit op aarde), hoewel ze officieel neit katholiek zijn en runnen een miljardenbedrijf op kosten van de bevolking (50% eigenaar van Shell en vele andere firma's)

De koning is geen nazaat van Willem van Oranje
Welke bloedlijn zou dan gevolgd moeten worden: ons is verteld dat het de mannelijke kant is, maar voor de Joden geldt de vrouwelijke bloedlijn. Bij de vermeende Oranjes is er eerder sprake van een Joodse bloedlijn.

Willem III heeft de nationale Bank aan de Joden verkocht
en heeft daarmee 'zijn Volk' in de uitverkoop gedaan.
Een ieder die zoiets doet heeft geen enkel recht om aanspraak op een 'troon' te maken.

De 'Koninklijke' familie heeft tijdens de tweede wereldoorlog tegen de grondwet in de Troon buiten het koninkrijk geplaatst

Welke organisaties mogen mijn burgerservicenummer (BSN) gebruiken?

Alle overheidsorganisaties mogen gebruik maken van uw burgerservicenummer (BSN). Andere organisaties mogen uw BSN gebruiken als dit in een wet staat.

Gebruik BSN door overheidsorganisaties

Overheidsorganisaties gebruiken uw BSN om hun taak uit te voeren. Dat mag alleen als uw BSN hierbij nodig is. Overheidsinstanties krijgen alleen de gegevens die ze nodig hebben. Ze krijgen dus niet al uw gegevens.

Gebruik BSN door andere instanties

Organisaties buiten de overheid mogen uw BSN gebruiken als dit in een wet is bepaald. En alleen voor het doel dat in de wet staat omschreven. Een zorgverlener (zoals uw huisarts of tandarts) is bijvoorbeeld verplicht uw BSN te gebruiken. Dat staat in de Wet gebruik burgerservicenummer in de zorg. En banken moeten uw BSN gebruiken voor uitwisseling van gegevens met de Belastingdienst. Dit staat in de Algemene Wet inzake Rijksbelastingen.

Uitwisseling persoonsgebonden gegevens

Organisaties mogen uw BSN alleen gebruiken als het om de uitwisseling van persoonsgegevens gaat. Een organisatie mag uw BSN dus niet gebruiken als deze geen gegevens van u hoeft vast te leggen.

Wat is het burgerservicenummer (BSN)?

Het burgerservicenummer (BSN) is uw eigen persoonsnummer voor contact met de overheid. Bijvoorbeeld voor zorg of belastingen. U krijgt een BSN toegekend als u zich inschrijft in de Basisregistratie Personen (BRP).

Burgerservicenummer opvragen

Uw BSN staat op uw paspoort, rijbewijs en identiteitskaart. Het burgerservicenummer op paspoorten die vanaf 9 maart 2014 zijn uitgegeven wordt niet meer vermeld bij de overige persoonsgegevens, maar op de achterkant van de pagina met de persoonsgegevens (de zogenaamde houderpagina). In de Nederlandse identiteitskaart is het BSN vermeld op de achterkant van de kaart. Deze wijzigingen zijn doorgevoerd in het kader van de aanpak voor het voorkomen van identiteitsfraude. Het nummer bestaat uit 9 cijfers. Heeft u een identiteitsbewijs, maar staat uw BSN daar niet op? Dan kunt u bij de gemeente uw BSN opvragen.

Geldigheid BSN

De geldigheid van het BSN is onbeperkt. Ook als u in het buitenland gaat wonen, blijft uw BSN geldig.

Een BSN is uniek gekoppeld aan een persoon. Als iemand is overleden, blijft het BSN gekoppeld aan deze persoon en wordt niet opnieuw uitgegeven.

Het sofinummer (afkorting van sociaalfiscaal nummer) is een tot 7 januari 2014 door de Nederlandse rijksbelastingdienst aan een natuurlijk persoon toegekend identificerend nummer. Het nummer diende tevens als registratienummer voor de verzekerde of uitkeringsgerechtigde voor de uitvoering van wettelijke voorschriften inzake de sociale zekerheid. De invoering van het sofinummer, waar veel debat over privacy aan voorafging, werd geregeld in de Wet persoonsregistratie (Stb. 1988, 655).

 

Met de invoering van de Wet Basisregistratie personen (Brp), en de Aanpassingswet Brp op 6 januari 2014, worden er geen sofinummers meer toegekend. Iedereen die zich als ingezetene, of als niet-ingezetene, laat inschrijven in de Brp, krijgt door de minister van Binnenlandse Zaken en Koninkrijksrelaties of de gemeente een burgerservicenummer toegekend.

 

Van alle op 26 november 2007 bij de Nederlandse gemeenten ingeschreven personen is het sofinummer qua terminologie en strekking officieel vervangen door het burgerservicenummer (BSN). Sinds die datum wordt door gemeenten bij inschrijving een BSN toegekend. De belastingdienst neemt dit nummer vervolgens over in haar administratie, en gebruikt het daar ter vervanging van het sofinummer.

 

Het sofinummer werd al sinds 2006 op het rijbewijspaspoort en identiteitskaart aangegeven als BSN of persoonsnummer, behalve op reisdocumenten verstrekt aan Nederlanders die niet in (het Europese deel van) Nederland wonen. Vaak wordt gedacht (bijvoorbeeld bij het aanleggen van een database) dat het sofinummer uniek is, dit is niet het geval. Op één sofinummer kunnen ook groepen van personen zijn geregistreerd, bijvoorbeeld zeevarenden.

 

Het belangrijkste verschil tussen sofinummer en BSN is de eigenaar: het sofinummer werd beheerd door het ministerie van Financiën en het burgerservicenummer door het ministerie van Binnenlandse Zaken.

 

Het sofinummer bestaat uit 8 of 9 cijfers en voldoet aan een variant van de zogenaamde elfproef: als het sofinummer wordt voorgesteld als ABCDEFGHI, dan moet:

een veelvoud van 11 zijn. Om alle Nederlanders een uniek sofinummer of BSN te geven dat ook nog aan deze variant van de elfproef voldoet moet een nummer van 9 cijfers voldoende zijn. Dat zijn nl. 1 miljard / 11 = ca. 90 miljoen nummers.

 

De Belastingdienst verklaarde dat het sofinummer betekenisloos is. Met andere woorden, uit (de opbouw van) het nummer was niets af te leiden over de houder(s) van het nummer.

 

De notatie zoals de Belastingdienst die gebruikte, was 4-2-3 (####.##.###). Deze notatie was ook in de nummers van aanslagen te vinden.

 

  • In 2003 ging de Belastingdienst nogal creatief om met persoonsgegevens. Een sofinummer werd aan 100 tot 500 personen toebedacht met de fictieve naam F. (Frans) Vogelpest. Frans was de voornaam van de Heerlense belastingambtenaar.

BSN in het onderwijs

In het onderwijs heet het BSN het persoonsgebonden nummer (PGN). Ook wel onderwijsnummer genoemd. Het PGN is hetzelfde nummer als het BSN. Scholen zijn verplicht het PGN te gebruiken in hun administratie.

BSN voor kinderopvangtoeslag, huurtoeslag en zorgtoeslag

 

Kinderopvangorganisaties zijn verplicht om u te vragen naar uw BSN en dat van uw kind. De Belastingdienst Toeslagen koppelt de administratie van het aantal gebruikte opvanguren aan de gegevens van de kinderopvangorganisatie. Dit geldt ook voor verhuurders voor de huurtoeslag en voor zorgverzekeraars voor de zorgtoeslag.

Identiteitsfraude voorkomen met BSN

Het BSN is in de eerste plaats bedoeld voor het contact tussen burgers en de overheid en voor overheden onderling. Organisaties buiten de overheid mogen het BSN alleen gebruiken als dat wettelijk is bepaald. Dit geldt bijvoorbeeld voor zorgverleners, zoals huisartsen, apotheken en zorgverzekeraars. Het nummer ondersteunt een foutloze uitwisseling van persoonsgegevens door overheidsorganisaties. Een organisatie is verplicht om te controleren of u en het BSN bij elkaar horen.

Wanneer moet ik mij in de Basisregistratie Personen (BRP) laten inschrijven als ingezetene?

Komt u langer dan 4 maanden in Nederland wonen, dan moet u zich als ingezetene laten inschrijven in de Basisregistratie Personen (BRP).

Inschrijven als u in Nederland komt wonen

U moet zich inschrijven bij de gemeente:  

  • op uw vaste woonadres;
  • op een briefadres, als u geen vast woonadres heeft. Bijvoorbeeld omdat u binnenvaartschipper bent, of in een instelling verblijft (gevangenis, psychiatrische instelling, blijf-van-mijn-lijf-huis).

U bent verplicht dit binnen 5 dagen na uw aankomst in Nederland te doen. Heeft u een partner en/of kinderen die ook naar Nederland zijn gekomen? Dan moeten zij meekomen naar de gemeente. Bij uw inschrijving krijgt u een burgerservicenummer (BSN) toegekend. Dit nummer heeft u in veel gevallen nodig voor contact met de overheid. Bijvoorbeeld voor zorg of belastingen.

Uitzonderingen inschrijven in de BRP

U kunt u zich niet altijd (direct) laten inschrijven in de BRP:

  • U moet rechtmatig in Nederland verblijven. U moet eerst een verblijfsvergunning aanvragen.
  • Uw identiteit moet eerst worden vastgesteld. Hiervoor moet wellicht extra onderzoek worden gedaan of moet u meer informatie aanleveren.

Opname en wijziging gegevens in BRP

Sommige gegevens van ingezetenen worden automatisch opgenomen of veranderd in de BRP. Bijvoorbeeld als u trouwt in Nederland. Dan geeft de ambtenaar van de burgerlijke stand dit door aan de gemeente. Of bij de geboorteaangifte van uw kind in Nederland. Uw kind wordt dan automatisch ingeschreven in de BRP. Dit kan alleen als een van de ouders op de geboortedag van het kind staat ingeschreven in de BRP. Er zijn ook gegevens die u zelf moet doorgeven. Bijvoorbeeld als u verhuist.

U woont niet of korter dan 4 maanden in Nederland

Woont u niet of korter dan 4 maanden in Nederland? Dan kunt u zich laten inschrijven als niet-ingezetene in de BRP met uw adres in het buitenland. Dit heet ook wel de Registratie niet-ingezetenen (RNI). U krijgt dan een BSN toegekend. Dit nummer heeft u in de meeste gevallen nodig voor contact met de overheid. Bijvoorbeeld voor zorg of belastingen.

Inschrijving bij verhuizing binnen Nederland

Verhuist u binnen Nederland naar een andere gemeente? Dan moet u zich laten inschrijven bij de gemeente waar u gaat wonen. De gemeente die u verlaat, zorgt voor de uitschrijving. Een verhuizing binnen dezelfde gemeente moet u ook doorgeven. Dat kan soms digitaal.

Uw gegevens in de BRP kloppen niet

Zijn uw persoonsgegevens in het BRP niet juist of onvolledig? Dan kunt u om een wijziging vragen. U gaat daarvoor met bewijsstukken en uw identiteitsbewijs naar uw gemeente. Bewijsstukken zijn de papieren die bewijzen dat uw gegevens niet kloppen. Bijvoorbeeld uw geboorteakte of een huwelijksakte.

Wanneer moet ik mij uit de Basisregistratie Personen (BRP) laten uitschrijven?

U moet zich laten uitschrijven als ingezetene uit de Basisregistratie Personen (BRP) als u in een jaar tijd langer dan 8 maanden in het buitenland verblijft. Deze periode hoeft niet aaneengesloten te zijn. Ook als u uw huis in Nederland aanhoudt, moet u zich laten uitschrijven uit de BRP.

Uitschrijven bij de gemeente

U moet zich laten uitschrijven bij de gemeente waar u woont. Dit doet u vanaf 5 dagen voor uw vertrek (en niet eerder). U moet dit persoonlijk doen. De gemeente geeft op uw verzoek een bewijs van uitschrijving. U gebruikt dit bewijs bijvoorbeeld bij uw inschrijving in het buitenland.

Na uitschrijving uit de BRP als ingezetene verhuist het overzicht met uw persoonsgegevens (persoonslijst) naar het niet-ingezetene-deel van de BRP. Dit heet ook wel de Registratie niet-ingezetenen (RNI). Dat is de registratie van personen die niet meer of korter dan 4 maanden in Nederland wonen.

Bewijs van uitschrijving aanvragen als u in het buitenland woont

Birth Certificate Bonds

Several internet blogs and videos make false claims that a United States birth certificate is a negotiable instrument (a document that promises payment) that can be used to:

  • Make purchases that will be charged to a “Exemption Account” (perhaps identified by your social security number or EIN), or
  • Request savings bonds held by the government in your name and owed to you.

The truth is, birth certificates cannot be used for purchases, nor can they be used to request savings bonds purportedly held by the government.  Also, the “Exemption Account” is a false term; these accounts are fictitious and do not exist in the Treasury system. 

The Story

This story is a variation of the older Bogus Sight Drafts/Bills of Exchange Drawn on the Treasury scam.

The common tale offered in this scam states: When the United States went off the gold standard in 1933, the federal government somehow went bankrupt. With the help of the Federal Reserve Bank, the government became a corporation (sometimes called ”Government Franchise”) and converted the bodies of its citizens into capital value, supposedly by trading the birth certificates of U.S. citizens on the open market and making each citizen a corporate asset (sometimes referred to as a “Strawman”) whose value is controlled by the government. 

Scams vary in methods for citizens to gain control of their alleged assets, such as:

  • filing a UCC-1 Financial Statement,
  • activating a Treasury Direct Account (TDA), or
  • creating bonds by using the Savings Bond Calculator.

These blogs and videos promise that your birth certificate bond will be able to wipe out all your debt or help you collect monies/securities. Some internet sites even offer to sell videos, webinars, and coaching on how to do this.  No one has profited from the Treasury Department by using these tactics.  But, the scammers intend to profit from this story by selling their bogus wares.

The Reality

There is no monetary value to a birth certificate or a social security number/EIN, and Treasury Direct accounts must be funded by the owner (through payroll deductions or from purchasing directly from the owner's personal bank account) to have any value. 

The Savings Bond Calculator is merely a tool to calculate the value of a bond based on an issue date and denomination entered.  This information could be the issue date and denomination from a real bond, or it could just be a random choice of a date and denomination.  The calculator only checks that the issue date and denomination entered are a valid combination - it will not verify whether a bond exists.  The calculator will not verify the validity of a serial number or confirm bond ownership.

Please be advised that trying to defraud the government by claiming rights to bogus securities is a violation of federal law, and the Justice Department can and has prosecuted these crimes. Federal criminal convictions have occurred in several cases. The scam artists who post blogs and videos are trying to defraud you into buying their fake product.  Do not fall victim to their schemes.

Royal House

The monarch is the head of state and, together with the ministers, makes up the government. Under the Constitution, the monarch is ‘inviolable’, which means that the Ministers are politically responsible for the actions of the head of state and, to a lesser extent, of the other members of the Royal House.

 

 

The Royal House consists of the monarch, the former head of state, the members of the royal family who are related to the monarch in the first or second degree of consanguinity and are eligible for succession to the throne, and their spouses.

Members of the royal family who were already members of the Royal House before the transitional arrangement was introduced in the Membership of the Royal House Act of 2002 retain their status.

Minister

Een minister is een persoon die deelneemt aan de regering van een land, en die over het algemeen ook leiding geeft aan een ministerie.

Het woord minister is overgenomen uit het Latijn, waar het woord 'minister' dienaar betekent. Oorspronkelijk werd het vooral gebruikt om huisdienaren aan te duiden. In het christelijke Latijn duidde het de dienaren van God aan, oftewel de priesters, diakens, enz.

Sinds de 10e eeuw werd het woord gebruikt om dienaren, meer bepaald de raadgevers, van de koning aan te duiden. In de loop van de eeuwen verwierven de ministers langzamerhand meer uitvoerende macht, en zo verkreeg het begrip zijn huidige betekenis.

 

De eerste minister (primus inter pares) of de minister-president die ook minister is vervult de rol van voorzitter van de ministerraad. Een of meer ministers kunnen de rol van viceminister-president oftewel vice-eersteminister vervullen en indien nodig de minister-president of eerste minister bij gelegenheid vervangen.

 

De regering van Nederland telt naast de koning momenteel (2017) zestien ministers, die zich elk met een bepaald (beleids)terrein bezighouden. Het regeringsbeleid is een gezamenlijke verantwoordelijkheid van alle ministers. Belangrijke beslissingen moeten daarom in de wekelijkse vergadering van de ministerraad worden genomen. Deze staat onder voorzitterschap van de minister-president die daarnaast de belangrijke taak heeft om de eenheid te bewaren. De ministers zijn naast minister van het land Nederland tevens allemaal minister van het Koninkrijk der Nederlanden en in die hoedanigheid maken zij onderdeel uit van de Koninkrijksregering. De ministers van Buitenlandse Zaken en Defensie treden feitelijk altijd op in hun hoedanigheid van Rijksminister, omdat hun portefeuilles zich geheel binnen het terrein van de Koninkrijksaangelegenheden bevinden. In wetgeving worden zij aangeduid als 'Onze Minister van Buitenlandse Zaken' en 'Onze Minister van Defensie', zonder de toevoeging 'in zijn hoedanigheid van Minister van het Koninkrijk', omdat het duidelijk is dat zij altijd als Rijksminister optreden.

 

Salaris

In 2014 bedroeg het salaris van een minister 144.000 euro op jaarbasis (incl. vakantiegeld, excl. eindejaarsuitkering en vaste onkostenvergoeding). Het salaris van de minister-president bedraagt ook 144.000 euro. De balkenendenorm is een salarishoogte van 180.000, dat is het bedrag waarvan het aanvankelijk de bedoeling was dat de premier dit zou gaan verdienen. Die verhoging is niet doorgegaan, de naam balkenendenorm is gebleven. De precieze hoogte kan het ministerie van Binnenlandse Zaken niet geven, want er komen ook nog toeslagen bij.

Minister zonder portefeuille

Op sommige ministeries zijn er ministers zonder portefeuille, die wel deelnemen aan het kabinetsberaad en een eigen beleidsterrein hebben, maar geen leiding geven aan een ministerie. Veel ministers worden bijgestaan door een staatssecretaris die een bepaald deel van het beleidsterrein voor zijn of haar rekening neemt. Een staatssecretaris is een soort onderminister, maar hij maakt geen deel uit van de ministerraad. Hij komt alleen bij een vergadering van het kabinet als een onderwerp op zijn terrein ter sprake komt.

Voorbeeld van een minister zonder portefeuille is de minister voor Wonen en Rijksdienst. De ambtenaren die zich met dit onderwerp bezighouden, werken bij het ministerie van Binnenlandse Zaken en Koninkrijksrelaties. Het budget van Wonen en Rijksdienst maakt ook onderdeel uit van de begroting van dit ministerie.

Een minister zonder portefeuille is in de titulatuur te herkennen, omdat hij altijd "minister voor" een bepaald terrein is. Ministers met portefeuille (die dus aan het hoofd staan van een ministerie), heten altijd "minister van" een bepaald ministerie.

Programmaminister / projectminister / coördinerend minister

Sommige ministers hebben een beleidsterrein dat meerdere beleidssectoren omvat of heel specifiek is of departementen overstijgend is of tijdelijk is. Deze ministers (zonder portefeuille) worden dan ook wel programmaminister of projectminister of coördinerend minister genoemd na hun aanstelling.

Benoeming / beëdiging / installatie / ontslag

Een minister wordt benoemd en beëdigd door de Koning met wie hij de regering vormt en legt daarbij een zuiveringseed af. Hij of zij kan daarbij kiezen voor de eed, de verklaring c.q. belofte.

Het is gebruikelijk dat een minister bij het aflopen van zijn grondwettelijke termijn van vier jaar of als gevolg van een politieke crisis, bij een persoonlijk feit, dan wel wanneer het vertrouwen is opgezegd zijn (of haar) ontslag aanbiedt aan de koning. Die kan dat vervolgens per direct verlenen of in beraad houden. Dit laatste is vaak het geval bij het demissionair worden als gevolg van verkiezingen.

De verlening van het ontslag wordt als Klein Koninklijk Besluit gepubliceerd in de Staatscourant. Op koninklijkhuis.nl wordt een bijbehorende Mededeling van het Kabinet van de Koning gepubliceerd.

Dit wordt normaal gesproken als volgt geformuleerd:

Minister-president: 

Een minister-president (mv: ministers-presidenten) is een particuliere benaming voor het hoofd van een soeverein orgaan, dat beschikt over uitvoerende macht van een staat of een deelstaat. Het is een regeringsleider of het hoofd van een regering. Het mag niet gaan over de voorzitter van een administratief of bestuurlijk orgaan, zoals provincies.

De benaming minister-president is een samenvoeging van minister, dat eigenlijk dienaar van de koning betekent, en president, dat voorzitterbetekent. Een minister-president is dus letterlijk de minister die de vergaderingen van de gezamenlijke ministers leidt.

In sommige landen, zoals Nederland en België, is minister-president dan ook een synoniem van premier of eerste minister. In andere landen kunnen die namen voor verschillende functies gebruikt worden. Andere gebruikte benamingen zijn kanselier en landvoogd.

Ontvoering

Vrijwel iedereen kent het verhaal van de ontvoering van Freddy Heineken en de ontvoering van Gerrit Jan Heijn. In beide zaken zijn de ontvoerders uiteindelijk aangehouden en berecht. Dit artikel gaat meer in het algemeen over ontvoering: wat is het precies en welke vormen zijn er? Welke straf staat er op deze verschillende soorten ontvoering? Hoe zit het met de mislukte ontvoering (‘poging tot ontvoering’)?

Ontvoering – Welke vormen zijn er?

Ontvoering is een term die inhoudt dat iemand tegen zijn wil in en tegen de wet in, van de ene naar de andere plaats wordt gevoerd of vervoerd. In het Wetboek van Strafrecht is de term ontvoering niet terug te vinden. Wel worden enkele soortgelijke delicten onderscheiden. Dit betreft: opzettelijke vrijheidsberoving, gijzeling, schaking en onttrekking van een minderjarige aan het wettelijk gezag.

Ten slotte bestaan er nog een aantal andere soortgelijke misdrijven die in dit artikel niet besproken zullen worden. Het gaat dan onder andere om mensenhandel en slavenhandel.

Opzettelijke wederrechtelijke vrijheidsberoving

Allereerst bestaat er de ‘opzettelijke wederrechtelijke vrijheidsberoving’, waarbij de dader iemand anders wederrechtelijk van de vrijheid berooft of beroofd houdt.

Deze vrijheidsberoving moet dus ‘wederrechtelijk’ zijn: het moet niet wettelijk zijn toegestaan (bijvoorbeeld wanneer iemand een ander aanhoudt na een misdrijf). Daarnaast moet het slachtoffer niet vrij weg kunnen of vrij zijn eigen gang kunnen gaan.

Het verschaffen van een plaats voor de opzettelijke wederrechtelijke vrijheidsberoving is ook strafbaar.

Gijzeling

Gijzeling komt het meest in de buurt bij wat in de volksmond vaak ontvoering wordt genoemd. Hierbij wordt iemand ook wederrechtelijk van zijn vrijheid beroofd, maar wordt dit tevens gedaan met het doel om iemand anders ergens toe te dwingen (bijvoorbeeld het betalen van losgeld).

Ook hier is het verschaffen van een plaats om de gijzeling te laten plaatsvinden strafbaar.

Schaking

Naast opzettelijke vrijheidsberoving en gijzeling bestaat er schaking. Schaking is de ontvoering van een (minderjarige) vrouw, met als oogmerk om zich haar bezit in of buiten echt te verzekeren. Het is dus de ontvoering van een (mogelijk minderjarige) vrouw om met haar te trouwen of in elk geval haar te behouden, zonder haar toestemming en zonder de wil van haar ouders. Dit kan ook het geval zijn bij meerderjarige vrouwen, al is daar wel vereist dat dit met een list, met geweld of met bedreiging met geweld gebeurt.

Schaking wordt indien de vrouw minderjarig is, enkel vervolgd na aangifte van haarzelf of van iemand wiens toestemming zij nodig heeft om te huwen (haar ouders). Wanneer de vrouw meerderjarig is, kan zijzelf aangifte doen, net als haar eventuele echtgenoot.

Onttrekking van een minderjarige aan het wettelijk gezag

Onttrekking van een minderjarige aan het wettelijk gezag (vaak ook ‘kidnapping’ genoemd) komt regelmatig voor. Vaak is het een van de ouders die het wettelijk gezag heeft over de minderjarige, waarna de andere ouder zich schuldig maakt aan ‘ontvoering’ van de minderjarige. Ook ‘gewone’ ontvoering van kinderen kan hieronder vallen.

Het verbergen van een minderjarige die door dit soort ontvoering aan het wettelijk gezag is onttrokken is ook strafbaar.

De hoogte van de straf voor deze vormen van ontvoering

De hoogte van de straf voor ontvoering is bij een veroordeling voor ontvoering voornamelijk afhankelijk van de omstandigheden van het geval. Er kan dus niet veel over worden gezegd in dit artikel. Waar wel naar kan worden gekeken zijn de maximumstraffen, aangezien deze uiteraard ook aangeven hoe zwaar de rechter theoretisch zou kunnen straffen. Deze maximumstraffen voor de verschillende vormen van ontvoering zijn als volgt:

Opzettelijke wederrechtelijke vrijheidsberoving: 8 jaar;

~ met zwaar lichamelijk letsel tot gevolg: 9 jaar;

~ met de dood tot gevolg: 12 jaar;

~ met terroristisch oogmerk: 30 jaar.

Gijzeling: 15 jaar;

~ met de dood tot gevolg: 30 jaar;

~ met terroristisch oogmerk: 30 jaar.

Schaking:

~minderjarige vrouw: 6 jaar;

~meerderjarige vrouw (+list, geweld of bedreiging met geweld): 9 jaar.

Onttrekking minderjarige aan wettelijk gezag: 6 jaar;

~ met list, geweld of bedreiging met geweld: 9 jaar;

~ bij iemand onder de 12 jaar oud: 9 jaar;

Poging tot ontvoering

De mislukte ontvoering of poging tot ontvoering is ook strafbaar. De maximumstraf is dan echter wel 1/3 lager dan de hierboven weergegeven maximumstraffen.

Er is sprake van poging tot ontvoering (poging tot een bepaalde vorm van ontvoering) wanneer er reeds is begonnen met de uitvoering van de ontvoering, maar deze om externe redenen niet is afgemaakt. Wanneer er nog niet is begonnen met de uitvoering is er geen strafbaarheid voor poging tot, net als wanneer de dader uit zichzelf heeft besloten dat hij het misdrijf niet moest voltooien.

Recidive: meerdere malen iemand ontvoeren

Wanneer iemand zich meerdere malen schuldig maakt aan (een vorm van) ontvoering, zal dat invloed hebben op de strafmaat en kan dat invloed hebben op de maximumstraf.

Iemand die veroordeeld wordt voor meerdere ontvoeringen kan meestal al enkel om die reden een hogere straf tegemoet zien. Daarnaast wordt de maximumstraf met 1/3 verhoogd wanneer het afzonderlijke ontvoeringen waren en ze niet als één voortgezette handeling gezien moeten worden (bijvoorbeeld het tegelijkertijd ontvoeren van twee personen).

Ook wanneer iemand reeds is veroordeeld voor een vorm van ontvoering, is het waarschijnlijk dat de rechter hem een hogere straf op zal leggen. Dit zal zo zijn omdat de rechter het niet hebben van een ‘blanco strafblad’ laat meewegen. Daarnaast zal een eventuele voorwaardelijke straf alsnog moeten worden uitgezeten. Ook de maximumstraf wordt met 1/3 verhoogd wanneer de recidive binnen vijf jaar plaatsvindt.

Ontvoering – Conclusie

Ontvoering is een term die niet in het Wetboek van Strafrecht voorkomt. Wel zijn er enkele vormen van het beroven van iemands vrijheid die in de volksmond ‘ontvoering’ genoemd worden. Dit zijn zware misdrijven met hoge maximumstraffen die grofweg variëren van 6 tot 30 jaar gevangenisstraf. Ook poging tot (enige vorm van) ontvoering is strafbaar. Recidive wordt, net als bij alle andere delicten, meestal zwaarder bestraft.

Wanneer iemand terecht of onterecht wordt verdacht van het hebben gepleegd van enige vorm van ontvoering, is het verstandig om zo snel mogelijk contact op te nemen met een juridisch specialist.

Babylonisch recht

Het Babylonisch recht is een van de oudste rechtssystemen in de wereld en is voornamelijk gebaseerd op het ius talionis-principe ("vergeldingsrecht"). Vooral de opeenvolgende "codificaties" zijn kenmerkend alsook het sterk ontwikkelde verbintenissenrecht.

Het bronnenmateriaal betreffende de studie naar het Babylonisch recht is buitengewoon uitgebreid. Er zijn duizenden zogenoemde "contracten", waaronder een grote verscheidenheid aan aktenoverdrachtsaktencontractenontvangstbewijzenrekeningen, en het belangrijkst van allen, de daadwerkelijke wettelijke beschikkingen die door de rechters in de gerechtshoven werden uitgesproken. Historische inscriptieskoninklijke oorkondes en decreten, officiële verslagen, privébrieven en de algemene literatuur geven ons welkome aanvullende informatie. Zelfs grammaticale en lexicografische werken bevatten vele fragmenten of korte zinnen die betrekking hebben op de wet of op gewoonte. Het zogenoemde "Sumerische familierecht" is op deze manier bewaard gebleven.

De ontdekking van het inmiddels beroemde Wetboek van Hammurabi (of Codex Hammurabi, hierna genoemd “Codex”) heeft een meer systematische studie mogelijk gemaakt dan door classificatie en interpretatie van ander bronnenmateriaal mogelijk was geweest. Er bestaan fragmenten van een later wetboek, die ook gepubliceerd zijn; maar er zijn nog steeds vele punten waarop geen bewijsmateriaal voorhanden is.

Dit bronnenmateriaal dateert van de vroegste geschiedenis tot aan het begin van het christelijke tijdperk. Bewijsmateriaal over een bepaald onderwerp kan overvloedig zijn in de ene periode, en vrijwel geheel ontbreken in de andere. De Codex vormt de basis voor het schetsmatige beeld dat hier wordt gereconstrueerd. De fragmenten hiervan die verkregen zijn uit de bibliotheek van Assur-bani-pal in Niniveh en latere Babylonische exemplaren tonen aan dat het materiaal werd bestudeerd, in hoofdstukken ingedeeld, een titel kreeg (Ninu ilu sirum, naar de openingswoorden) en gedurende vijftienhonderd jaar of meer steeds opnieuw werd gekopieerd. Het overgrote deel ervan bleef van kracht, zelfs gedurende de Perzische, Griekse en Parthische veroveringen, die het privéleven in Babylonië slechts minimaal beroerden. Het is zelfs zo lang van betekenis geweest dat het Syro-Romeinse recht en later het Islamitische recht in Mesopotamië erdoor beïnvloed kon worden.

De wetten en gewoonten die aan de Codex voorafgingen, zullen we “vroeg” noemen; die van het Neo-Babylonische keizerrijk (evenals het Perzische, Griekse etc.) noemen we “laat”. De Assyrische wetgeving is een afgeleide van de Babylonische, maar heeft vroege kenmerken behouden, lang nadat die elders verdwenen waren.

Als lid van de Europese Unie heeft Nederland het Europese Verdrag voor de Rechten van de Mens ondertekend. 

Alhoewel in artikel 5 staat dat niemand mag worden opgesloten omdat deze een schuld niet kan betalen, doet de CJIB Gestapo in ons land dat desondanks wél. 


Aan de walgelijke gewoonte van de corporate managers in Den Haag om mensen die een boete niet betalen op te laten sluiten, moet onmiddellijk een einde komen. 

Dat zij daar zitten als vertegenwoordigers van de grote bedrijven met prachtige commissariaten in het vooruitzicht in plaats van het volk te vertegenwoordigen, is al erg genoeg, maar de mensonterende gewoonte tot het opsluiten van het arme deel van de bevolking is de druppel die de emmer doet overlopen. 

We hebben enkele dagen geleden kunnen zien hoe in Duitsland eindelijk de hooivorken tevoorschijn komen en mensen het bedrog van hun overheid niet langer accepteren:

Een groot deel van de Duitse bevolking is het spuugzat dat hun land door politici wordt verraden en pikken het niet langer. 

Toen de Duitse Minister van Justitie, Heiko Maas, op de dag van de Arbeid een toespraak wilde houden, werd deze met boe geroep en kreten als “verrader” van het toneel gejaagd. 

In ons land zijn ondertussen waarschijnlijk al enkele honderdduizenden mensen slachtoffer geworden van de staats afpersdienst, het CJIB. 

Duizenden andere Nederlanders werden vorig jaar gegijzeld door het CJIB omdat ze hun boetes niet betaalden. CJIB wil de meest recente cijfers niet geven, maar in 2012 steeg het aantal zaken waarbij het CJIB om gijzeling vroeg met 21 procent, naar 57.765 zaken. 

Het wordt hoog tijd dat al die duizenden slachtoffers van de terreur uit Den Haag zich, samen met toekomstige slachtoffers, gaan verenigen om een einde te maken aan deze Middeleeuwse praktijken. 

We hebben dit volgens een in dit onderwerp gespecialiseerde website te danken aan de laffe beschermer van Joris Demmink: 

De wens dit zware middel in te zetten is afkomstig van voormalig Staatssecretaris Teeven. Hij wil zijn spierballen laten zien, om de miljoenen euro’s van onbetaald gebleven boetes alsnog te kunnen innen. 

Lef heeft hij wel om zijn spierballen te laten zien tegenover mensen die te arm zijn om een boete te betalen. Jammer genoeg heeft hij niet het lef om zijn grote mond open te doen over Pedo Godfather Demmink voor wie hij bibbert als een schoothondje. 

Hierna volgt een ingezonden stuk van een lezer (dank!) die zich behoorlijk heeft verdiept in bovenstaande materie en waaruit blijkt dat de Nederlandse Gestapo ook nog eens volkomen onwettig bezig is:

Bij deze meld ik jullie een groot misverstand inzake het UVRM (Universele Verklaring van de Rechten van de Mens). 

Bijna iedereen denkt dat zij zich kunnen beroepen op het UVRM bij het schenden van mensenrechten. (lees goed mensenrechten) Dat is niet het geval. Alhoewel de Staat der Nederland deze in 1948 heeft ondertekend, is het voor de huidige bevolking niets betekenend. Ook ik ben slachtoffer geworden van de terreurorganisatie CJIB. 

Even een stukje geschiedenis over de Staatsvorm Koninkrijk der Nederlanden. Wij hebben als grondbeginsel een Statuut voor het Koninkrijk der Nederlanden. Hierin wordt bepaald hoe de Staatsvorm dient te worden uitgevoerd, maar hierin staan al een aantal zaken die zeer te denken geven. Ook de mensenrechten worden hierin beschreven. Lees nu goed wat hierover staat; 

Het Statuut voor het Koninkrijk der Nederlanden vermeld onder artikel 43: 

1. Elk der landen draagt zorg voor de verwezenlijking van de fundamentele menselijke rechten en vrijheden, de rechtszekerheid en de deugdelijkheid van het bestuur. 

• 2. Het waarborgen van deze rechten, vrijheden, rechtszekerheid en deugdelijkheid van bestuur is aangelegenheid van het Koninkrijk. 

• Zie je wat er staat, juist; deugdelijkheid van bestuur ............... 

Kortom, ze kunnen maar doen wat ze willen en daarbij komt nog bovenop dat de Hoge Raad heeft bepaald dat de men zich in Nederland niet aan het UVRM hoeft te houden of na te leven

Hoe komt dit? Heel simpel, namelijk iedereen in Nederland wordt geboren als mens maar zodra je aangifte doet van geboorte wordt er achter je rug om een identiteit gecreëerd in de vorm van de Natuurlijk Persoon. Zonder enige overeenkomst. Conclusie het UVRM gaat over Mensen en niet over de Persoon. Zo simpel is het en daarom houden zij zich er niet aan. 

Maar nu komt het inzake de Persoon zoals ook iets is vermeld in het UVRM, waaruit blijkt hoe wij besodemietert worden; 

UVRM art.3: Een ieder heeft het recht op leven, vrijheid en onschendbaarheid van zijn persoon. 

En UVRM art.6: Een ieder heeft, waar hij zich ook bevindt, het recht als persoon erkend te worden voor de wet. 

Ofwel ook uit de mensenrechten (die de Staat der Nederlanden in 1948 heeft ondertekend) blijkt duidelijk dat er een onderscheid bestaat tussen een Mens en een Persoon, er wordt zelfs aangegeven dat de Persoon eigendom is van een Mens. 

Gezien de wetgeving in Nederland is gebaseerd op de Persoon en niet op mensen, schendt de Staat der Nederlanden niet alleen het UVRM, maar ook de rechten van het Kind. 

Ik heb dus recht op een Natuurlijk Persoon voor de wet, maar dat houdt niet in dat ik ertoe verplicht kan worden. Ik heb naast die Natuurlijk Persoon ook recht op een Nationaliteit en kan ook daartoe niet verplicht worden. Ik kan niet gedwongen worden om tot de Staat der Nederlanden (= een associatie) te behoren alsook dat ik niet in slavernij of horigheid gehouden mag worden.

Resume; de Staat der Nederlanden misbruikt de PERSOON terwijl die eigendom is van een MENS zonder enige toestemming. 

Dan komen we op de Grondwet en daar staat duidelijk in artikel 94; 

“Binnen het Koninkrijk geldende wettelijke voorschriften vinden geen toepassing, indien deze toepassing niet verenigbaar is met een ieder verbindende bepalingen van verdragen en van besluiten van volkenrechtelijke organisaties.“ 

Duidelijk toch!!!!!!! 

Dan komen we bij nog iets en dat EVRM (Europees Verdrag voor de Rechten van de Mens) heet en ook daar staat namelijk iets in beschreven over het ontnemen van de vrijheid wat 99,9999999% van de bevolking niet weet en waar ik zelf heel diep heb voor moeten spitten.

Artikel 1

Verbod op vrijheidsbeneming wegens schulden

Aan niemand mag zijn vrijheid worden ontnomen op enkele grond dat hij niet in staat is een contractuele verplichting na te komen. (Ik heb geen contract ondertekend)

En dat kan je artikel 5 EVRM van kracht laten worden indien je vrijheid wordt ontnomen; Een ieder die het slachtoffer is geweest van een arrestatie of detentie in strijd met de bepalingen van dit artikel. heeft recht op schadeloosstelling. 

Gezien het feit dat geen enkele Nederlander een overeenkomst heeft met de Staat der Nederlanden inzake zijn PERSOON zijn de handelingen van de Staat niet legaal. Zij misbruikt de Persoon om de onwetende mens te misbruiken als geldslaaf en eigendom van de Staat. 

De handelingen van de Staat der Nederland zijn niet legaal ten aanzien van de mens en voor landen die zich niet houden aan het UVRM is speciaal de "Bill of Human Rights" in het leven geroepen om deze alsnog aan te kunnen pakken. 

Het zieke van dit alles is dat bijvoorbeeld Amnesty International de "grote mensenrechtenorganisatie" niets wil doen aan deze wantoestanden en corruptie in Nederland. 

Burgers van Nederland zouden moeten beseffen en kennis vergaren hoe ze worden besodemietert in plaats van voor de televisie te zitten.

In the US, each state has its own corporate law. Corporations in the US are formed under the auspices of the corporate laws of a particular state. For example, a corporation formed under the Delaware General Corporation Law will be a Delaware Corporation, and its “state of incorporation” will be Delaware; a corporation formed under the New York Business Corporation Law will be a New York Corporation, and its “state of incorporation” will be New York.

There is no overarching “United States Corporate Law” under which a corporation may be formed.

In the US, companies law is handled at the state level, rather than by a federal body. In most contexts, the term “state of incorporation” simply refers to the state in which your company is incorporated.

Delaware is the most popular for two reasons: state taxes, and an established body of corporate law. If you’re interested, look up the Delaware Court of Chancery.

Entities in the United States are formed at the State level, so the state of incorporation is the state where the entity has a domestic entity registration. I.e. the entity was first registered, NOT necessarily where the entity does business.

That is where things get a little more complex. Entities can also do business in other states, and in some cases, will have to file for what is called an foreign entity registration. For example many Silicon Valley Startups are registered as Delaware C-Corporations (this is their “state of incorporation”), but are also registered as foreign entities in the state where they reside and conduct business (California Foreign Entity Registration).

So what does this all mean?

Well, for certain legal entity level issues, the law of the state of incorporation applies, whereas the entity still has to comply with the laws of the other jurisdictions (including the state in which in conducts business and has the foreign entity registration).

For tax purposes, it can be a bit more complex. States like Delaware who do not charge tax on income to companies simply registered there, companies will largely pay taxes in the state where they reside and conduct business (in this example California).

The Law of Persons

Abstract

The Roman law of persons is defined as the body of rules concerned with the legal position of the human person (persona) comprising their rights, capacities and duties. It pertained to the various aspects of a persons status (status or condicio) as an individual, as a member of the community and as a member of a family hence it includes the law of marriage and family relations. Although the concept of persona underwent a long process of evolution, it has meant simply human being(homo) since the classical period. Hence even slaves (servi) were considered persons, despite the fact that in modern legal doctrine a slave was a legal object of rights and duties whereas a free person was a legal subject or a holder of rights and duties. Although Roman law also recognized non-human subjects of rights and duties, such as private corporations and public enterprises (labelled in contemporary law as juristic persons), these entities were not considered persons for the reason that in the eyes of the law only the natural person was a persona.

In de Grondwet wordt bij artikel 17 een nieuw eerste lid toegevoegd. Hiermee komt artikel 17 te luiden:

Dus als je niet zeker bent van een verbintenis en je weet zeker dat je niet art 3:35 BW of art 3:61 BW hebt voldaan dus die twee duidelijk hebt afgewezen, ga je in rechtsvordering art 21 RV art 150 RV op straffen van art 227a Sr art 227b Sr en dan zitten ze in jouw contract art 6:162 BW en leg je je claim

Volmacht verlening en schijn van volmacht
Een volmacht kan uitdrukkelijk of stilzwijgend worden verleend.
Is een rechtshandeling in naam van een ander verricht, dan kan tegen de wederpartij, indien zij op grond van een verklaring of gedraging van die ander heeft aangenomen en onder de gegeven omstandigheden redelijkerwijze mocht aannemen dat een toereikende volmacht was verleend, op de onjuistheid van deze veronderstelling geen beroep worden gedaan.
Indien een volgens wet of gebruik openbaar gemaakte volmacht beperkingen bevat, die zo ongebruikelijk zijn dat de wederpartij ze daarin niet behoefde te verwachten, kunnen deze haar niet worden tegengeworpen, tenzij zij ze kende.

Toelichting
Een volmacht wordt door de volmachtgever verleend aan de gevolmachtigde. Hier zijn geen vormvereiste aan verbonden. Er dient alleen sprake te zijn van een wil en een verklaring, de wilsvertrouwensleer. De volmacht kan dus zowel uitdrukkelijk als stilzwijgend worden verleend.

Schijn van volmachtverlening
De gevolmachtigde verricht rechtshandelingen in de naam van de volmachtgever met een derde, de wederpartij. Die wederpartij vertrouwt erop dat er sprake is van een volmachtverlening, maar soms is daar geen sprake van. De pseudo-volmachtgever wil dan helemaal niet gebonden zijn aan de rechtshandelingen die in zijn naam zijn verricht. Het feit dat er geen volmacht is verleend, kan echter niet aan de wederpartij worden tegengeworpen indien de schijn van volmachtverlening door de pseudo-volmachtgever is gewekt. Dit kan door een actieve handeling, maar ook door een nalaten. Bijvoorbeeld door een bepaalde situatie te laten voort bestaan en/of niet in te grijpen. Hierbij is niet van belang of sprake is van enige vorm van verwijtbaarheid.

 

 

Moet je art. 6:162 BW ook in je brieven vermelden? En wat voor claim bedoel je dan....graag een klein voorbeeld.

 

  • Als je iemand voorlicht voor hun bewustwording mensen die ook niet weten hoe het recht en de wet er op werken is het wel handig ze over de situatie te informeren gezien het een verbintenis door schuld is weten wordt ook geweten.
  • Schuld in claim! iets wat je bij vrije wil doet zo ik jullie informeer kost mij tijd tijd die ik nooit van mijn leven meer terug krijg maar ook niet aan mij zelf kan besteden iets voor me zelf te kunnen doen. maar dat is in vrijheid een keus. Als mensen inbreuk op je rechtmaken waar tegen je jezelf moet verdedigen kost ook dat tijd stres woede en vaak nog meer namelijk immateriële schade. maar je tijd ben je kwijt en krijg je nooit van je leven meer terug Dus wat is jouw tijd waard? die uren breng je dus in rekening
    Verschil materiële en immateriële schade
  • vergeet niet dat geestelijke mishandeling een zware mishandeling is dat ook een schending van internationaal recht is en dus ook immateriële schade veroorzaakt art 285 b Sr art 285 Sr Artikel 303 Sr 1. Zware mishandeling gepleegd met voorbedachten rade wordt gestraft met gevangenisstraf van ten hoogste twaalf jaren of geldboete van de vijfde categorie. 2. Indien het feit de dood ten gevolge heeft, wordt de schuldige gestraft met gevangenisstraf van ten hoogste vijftien jaren of geldboete van de vijfde categorie. Artikel 305 Sr Bij veroordeling wegens een der in de artikelen 301 en 303 omschreven misdrijven kan ontzetting van de in artikel 28, eerste lid, onder 1°, 2° en 4°, vermelde rechten worden uitgesproken.

 

Verschil materiële en immateriële schade

Materiële schade is schade die direct in geld is uit te drukken. Hiervan is bijvoorbeeld sprake bij beschadiging van uw eigendommen (bijvoorbeeld auto, fiets of kleding) maar ook misgelopen inkomen, kosten voor het ziekenhuis, reiskosten, huishoudelijke hulp en dergelijke.

Behalve de direct zichtbare schade, zoals beschadigingen aan spullen, kunnen er ook nog andere kosten zijn. Denk hierbij aan de kosten die gemaakt worden voor het inhuren van (tijdelijke) huishoudelijke hulp, voor het huren van hulpmiddelen en voor medische voorzieningen die niet door de zorgverzekeraar worden vergoed.

Wat is immateriële schade?

Immateriële schade is schade veroorzaakt door verdriet, de pijn en het verlies aan levensvreugde na een ongeval. Een schadevergoeding die wordt uitgekeerd voor immateriële schade wordt ook wel smartengeld genoemd. Het slachtoffer zelf heeft recht op smartengeld. Daarnaast kunnen bij zeer ernstig letsel of zelfs overlijden ook de partner of eventuele kinderen recht hebben op een bijzondere vorm van smartengeld als gevolg van de Wet Affectieschade. Ook kan er sprake zijn van een recht op shockschade bij nabestaanden na de confrontatie met (de gevolgen van) een zeer ernstig ongeval.

Verschil tussen materiële en immateriële schade

Het verschil tussen materiële en immateriële schade zit ‘m dus in concrete, zichtbare kosten tegenover minder grijpbare, emotionele schade die lastiger in bedragen zijn uit te drukken.

Letselschadeslachtoffers hebben ook recht op een vergoeding van zowel materiële als immateriële schade. Immateriële schade wordt ook wel smartengeld genoemd. 

Smartengeld is een vergoeding voor pijn en leed en gederfde levensvreugde. De hoogte van het smartengeld is afhankelijk van alle omstandigheden van het ongeval. Er wordt daarbij onder andere gekeken naar de aard en de ernst van het letsel en de gevolgen van het letsel voor het leven van het slachtoffer. Bij materiële schade zal de vergoeding gericht zijn op de financiële schade die wordt ondervonden.

Wanneer u materiële en immateriële schade heeft opgelopen, is het erg belangrijk om een letselschadespecialist te benaderen. Als slachtoffer is de kans groot dat u schade over het hoofd ziet, of dat de gevolgen van opgelopen schade niet duidelijk zijn. Terwijl deze wel degelijk impact hebben op uw toekomst.

Voorbeelden van materiële schade

Materiële schade kan worden vastgesteld aan de hand van een berekening. Simpele voorbeelden zijn de kosten van vervanging of reparatie van een beschadigd eigendom. Verder kunnen onder materiële schade de volgende zaken vallen:

  • Extra kosten voor persoonlijke verzorging en extra slijtage kleding
  • Gederfde inkomsten
  • Noodzakelijke verhuiskosten
  • Noodzakelijk aanpassingen van uw woning en/of auto
  • Medische kosten zoals eigen risico zorgverzekering en kosten verblijf ziekenhuis
  • Extra vervoerskosten
  • Eventueel verschuldigde hogere verzekeringspremies
  • Kosten van noodzakelijke hulp in huis, tuin of voor onderhoud huis
  • Kosten van het verhalen van de schade en wettelijke rente bij schadevergoeding

Het betreft hier allemaal schadeposten waar een duidelijk prijskaartje aan te hangen is. Dit in tegenstelling tot de immateriële schade.

Voorbeelden van immateriële schade

Immateriële schade heeft dan ook betrekking op  de ‘verborgen’ psychische schade. Het is niet in geld uit te drukken omdat het geen schade is die direct te repareren of te herstellen is. Slachtoffers lopen vaak tegen een muur van onbegrip op: van zowel de verzekeraar van de tegenpartij als van mensen in de eigen omgeving.

Immateriële schadevergoeding is dan ook bedoeld ter verzachting van de pijn en het verdriet van het slachtoffer. Enkele voorbeelden van immateriële schadeposten zijn:

  • (Chronische) pijn
  • (Blijvende) psychische klachten
  • Lichte tot zware depressie
  • Angstklachten
  • Trauma’s
  • (Blijvende) invaliditeit
  • Verdriet
  • Littekens

Deze vormen van psychisch letsel worden vergoed in de vorm van smartengeld.

Berekenen van immateriële en materiële schade

Materiële schade berekenen is een kwestie van alle concreet gemaakte kosten bij elkaar optellen, ook de kleine bedragen die op het eerste gezicht voor u onbelangrijk lijken. Voor het berekenen van immateriële schade zal uw letselschade jurist een aantal persoonlijke factoren meenemen in de bepaling van de schadevergoeding. De hoogte van de vergoeding voor immateriële schade is per persoon en per ongeval verschillend. Dit komt doordat:

  1. Het ongeval bij elk slachtoffer altijd weer anders is (denk daarbij bijvoorbeeld aan oorzaak, plek, betrokkenen, etc.)
  2. De letselschade per persoon verschilt
  3. Ieder slachtoffer een heel persoonlijk herstelproces doormaakt

Het soort letsel dat u opgelopen heeft is een belangrijke factor, net zoals uw leeftijd, of u levenslang beperkingen overhoudt en in welke mate uw hobby’s beïnvloed worden door het letsel.

Smartengeld bij immateriële schade

Door alle factoren mee te wegen, zal de behandelaar uiteindelijk tot een geldbedrag smartengeld komen. Dit geldbedrag wordt beoordeeld door de andere methode om een schadevergoeding te berekenen: de jurisprudentie. De ANWB smartengeldgids heeft veel uitspraken van rechters uit het verleden gebundeld en gepubliceerd. De gids wordt dan ook veel gebruikt door letselschadebehandelaars om smartengeld te bepalen.

De Smartengeldgids wordt als leidraad gebruikt bij het bepalen van de hoogte van uw smartengeld, maar bij de uiteindelijke berekening zal ook naar andere factoren worden gekeken, zoals:

  • De ernst van het ongeluk
  • De ernst van het letsel
  • De invloed van ontstane littekens
  • Hoeveel pijn en verdriet het slachtoffer heeft (gehad) van het ongeluk
  • De lichamelijke beperkingen die zijn ontstaan door het letsel
  • Hoe het herstelproces is verlopen
  • De leeftijd van het slachtoffer

Veel van deze punten kunnen pas beantwoord worden als uw herstelperiode ten einde is. Of als er geen zicht meer is op verder herstel. In de tussentijd claimen wij uiteraard al wel alvast een voorschot voor u op de immateriële schadevergoeding.

Materiële en immateriële schade: aansprakelijkheid

Indien u een ongeval heeft gehad, dan kunt u degene die daarvoor verantwoordelijk is aansprakelijk stellen en schadevergoeding eisen. Er zijn veel voorbeelden waarbij niet alleen materieel schadeletsel, maar ook immaterieel schadeletsel voor vergoeding in aanmerking komt.

Het berekenen van immaterieel schadeletsel is een ingewikkelde kwestie die u beter kunt overlaten aan een deskundige, bijvoorbeeld een letselschade jurist. Uw jurist is op de hoogte van de mogelijkheden en kan voor u een berekening maken van de materiële en immateriële schade. Soms is daarvoor nog advies nodig van een derde, bijvoorbeeld een psychiater of andere medicus. Het is verstandig om vanaf het moment dat u schade heeft geleden alle gemaakte kosten te noteren. Dit geldt voor de materiële en immateriële schade.
