De 10 geboden zijn de grondwetten. De Tora is juist van יְהֹוָה (God) afkomstig en heeft als doel goede mensen en een betere wereld te creëren. De liefde van God staat dus centraal. Ook bevat de Torah een groot aantal wetten en leefregels van elke levensfase: van kind tot volwassen. Omdat de Tora door יְהֹוָה (God) is opgesteld geldt deze eeuwig en kan niet vervangen worden.

HOEVEEL VERDIENT EEN RECHTER AAN SALARIS?

 

In Nederland bestaan een elftal rechtbanken, waar veel mensen in diverse functies werkzaam zijn. De functie die voor velen het meest tot de verbeelding spreekt, is die van rechter. Rechter word je niet zomaar, hieraan gaat een lang traject vooraf, waarop ik later terug zal komen. Rechter ben je echter wel voor het leven.

In de functie van rechter word je – voor het leven – door de koning benoemd. In de praktijk geldt deze benoeming meestal tot het zeventigste levensjaar. Wij als ‘gewone burgers’ mogen dus eigenlijk niet klagen wanneer met 67 jaar met pensioen wordt gegaan.

HOE WORD JE RECHTER?

Een eerste voorwaarde om tot rechter opgeleid en uiteindelijk benoemd te kunnen worden, is dat men van onbesproken gedrag moet zijn, met andere woorden, een rechter (in wording) mag niet beschikken over een strafblad of iets van dien aard.

Niet alle rechters hebben eenzelfde traject doorlopen om rechter te worden. Na het afronden van minimaal de HAVO kan vervolgens een HBO opleiding rechten worden gevolgd, waarop een schakeljaar volgt om toegelaten te worden tot de universitaire master opleiding voor rechten. Wanneer je van het VWO afkomt, kan direct de laatstgenoemde opleiding worden genoten.

Wanneer deze is afgerond, mag je jezelf jurist of ook wel Master of Laws noemen. Je kunt dan diverse functies uitoefenen, bijvoorbeeld jurist voor een gemeente. Indien twee jaar werkervaring is opgedaan als jurist, kan worden gesolliciteerd naar de functie van rechter. In dit geval zal opnieuw de studieboeken moeten worden in gedoken, er volgt namelijk een interne opleiding van vier jaar welke bestaat uit theorie en praktijk.

Naast de opleiding zal bovendien een aantal cursussen moeten worden gevolgd.

Mocht je als jurist minimaal zes jaar werkervaring hebben opgedaan, dan bestaat eveneens de mogelijkheid om te solliciteren naar de functie van rechter. Een speciale commissie buigt zich in dit geval over jouw ervaring en kennis.

Als zij jou capabel genoeg acht, volgt een verkorte interne opleiding waarna je mogelijk kunt worden benoemd tot rechter. De rechtbank vraagt dan bij de koning jouw benoeming aan, waarna de koning je zal benoemen. Een zeer uitzonderlijke situatie.

WAT VERDIEN JE ALS RECHTER AAN SALARIS?

Na jarenlang hard studeren, is daar het moment waarop het harde werken zich gaat uitbetalen. Hoewel in theorie mogelijk zou je met 26 jaar oud het vak van rechter kunnen uitoefenen (gezien de opleidingen en werkervaring is jonger haast onmogelijk), zijn de meeste rechters echter ouder dan 26 wanneer zij beginnen in het ambt.

Als beginnend rechter kun je ongeveer €5.100,- bruto per maand bijschrijven aan salaris. Indien meer ervaring wordt opgedaan, zal ook meer worden verdiend, dit kan dan oplopen tot €6.600,- bruto per maand. Dit is een jaarsalaris van dik 90.000 euro!

 

Het grote geld zal echter pas worden verdiend wanneer andere functies zullen worden vervuld. Denk dan bijvoorbeeld aan president van de rechtbank of procureur-generaal bij de Hoge Raad. In deze functies wordt meer dan €10.000,- bruto per maand en maximaal €12.500,- bruto per maand verdiend. Als je echt voor het grote geld wilt gaan, maak je de meeste kans wanneer flink wordt doorgeleerd en veel ervaring wordt opgedaan.

 

INTERNATIONALE RECHTERS

Zo verdienen de rechters van het Europese hof meer dan €20.000,- bruto per maand. Echter, per lidstaat van de Europese Unie kan slechts een rechter geleverd worden, hier bestaat dus veel concurrentie.

Zoals te lezen is, verdient een rechter niet slecht qua salaris. Echter, gezien de opleiding en de verantwoording die inherent is aan deze baan, maakt dat het salaris in verhouding minder exorbitant is dan het lijkt.

Omdat een rechter compleet onafhankelijk en niet beïnvloedbaar moet zijn, moet de hoogte van het salaris er voor zorgen dat er nooit vanwege (bijvoorbeeld) geldissues een beslissing wordt gemaakt in het voor- of nadeel van een verdachte.

Dus, mocht je zin hebben om te studeren om vervolgens veel geld te verdienen, dan kan beter een opleiding worden gevolgd voor een goedbetaalde functie in het bedrijfsleven en hierin ook gaan werken. Hier valt in veel gevallen meer geld te verdienen dan in de functie van rechter.

Wil je echter toch gaan voor die benoeming voor het leven, in een bijzondere functie met een fraai salaris, duik dan eens in de opleidingseisen voor de opleiding rechten!

Vrouwe Justitia is van oorsprong een Romeinse (AFGOD) godin en naderhand de personificatie van het recht. Een afbeelding van haar is vaak te vinden op gerechtsgebouwen en andere plaatsen waar vroeger recht werd gesproken. Haar Griekse tegenhangster is Themis.

Vrouwe Justitia wordt doorgaans afgebeeld als een geblinddoekte figuur, met in haar rechterhand een zwaard en in haar linkerhand een weegschaal. Op de oudste beeltenissen is zij nog afgebeeld met onbedekte ogen.

  • De blinddoek staat voor de rechtspraak zonder aanzien des persoons, dat wil zeggen dat niet de personen worden gehoord en veroordeeld, maar slechts de feiten en daden; (Er moet niet naar aanzien [rijk versus arm] gekeken worden)
  • De weegschaal stelt de afweging van de bewijzen en getuigenissen voor, die in het voordeel of nadeel van de verdachte spreken 
  • Het zwaard staat voor het vonnis dat wordt uitgesproken; (Ephesians 6:17) WORD OF YeHoVaH.

Soms ligt aan haar voeten de cornucopia, de Hoorn des Overvloeds.

Ik ben gelovig en ik zei tegen de rechter dat de Bijbel de Wet is.

"De rechter zei: "de wet zegt....."

Mijn antwoord naar de rechter was: Daar staat niets van in dit wetboek (KJV) Bijbel. Rechter: Nee maar dat is uw wet, maar ik heb een andere wet. En die pas ik hier toe, niet uw wet."

 

Ik laat mij niet de wet voorschrijven door degene die de wetten van YHWH / יְהֹוָה niet naleeft Moet ik dan mij conformeren naar iemand anders zijn wetten?

 

Wet algemene bepalingen Artikel 13

De regter die weigert regt te spreken, onder voorwendsel van het stilzwijgen, de duisterheid of de onvolledigheid der wet, kan uit hoofde van regtsweigering vervolgd worden.

 

De 10 geboden zijn de grondwetten. De Torah is juist van יְהֹוָה (God) afkomstig en heeft als doel goede mensen en een betere wereld te creëren. De liefde van God staat dus centraal. Ook bevat de Torah een groot aantal wetten en leefregels van elke levensfase: van kind tot volwassen. Omdat de Torah door יְהֹוָה (God) is opgesteld geldt deze eeuwig en kan niet vervangen worden.

 

Het verschil tussen Mozes en Jezus is dat de wetten nu in onze harten zitten en niet meer op papier/steen.

Let’s start with a look at Psalm 82, the psalm that Jesus quotes in John 10:34. The Hebrew word translated “gods” in Psalm 82:6 is Elohim. It usually refers to the one true God, but it does have other uses. Psalm 82:1 says, “God presides in the great assembly; he gives judgment among the gods.” It is clear from the next three verses that the word “gods” refers to magistrates, judges, and other people who hold positions of authority and rule. Calling a human magistrate a “god” indicates three things:

1) he has authority over other human beings,

2) the power he wields as a civil authority is to be feared, and

3) he derives his power and authority from God Himself, who is pictured as judging the whole earth in verse 8.

This use of the word “gods” to refer to humans is rare, but it is found elsewhere in the Old Testament.

 

For example, when God sent Moses to Pharaoh, He said, “See, I have made you like God to Pharaoh” (Exodus 7:1). This simply means that Moses, as the messenger of God, was speaking God’s words and would therefore be God’s representative to the king. The Hebrew word Elohim is translated “judges” in Exodus 21:6 and 22:8, 9, and 28.

The whole point of Psalm 82 is that earthly judges must act with impartiality and true justice, because even judges must stand someday before the Judge. Verses 6 and 7 warn human magistrates that they, too, must be judged: “I said, `You are gods; you are all sons of the Most High.' But you will die like mere men; you will fall like every other ruler.” This passage is saying that God has appointed men to positions of authority in which they are considered as gods among the people. They are to remember that, even though they are representing God in this world, they are mortal and must eventually give an account to God for how they used that authority.

Now, let’s look at how Jesus uses this passage. Jesus had just claimed to be the Son of God (John 10:25-30). The unbelieving Jews respond by charging Jesus with blasphemy, since He claimed to be God (verse 33). Jesus then quotes Psalm 82:6, reminding the Jews that the Law refers to mere men—albeit men of authority and prestige—as “gods.” Jesus’ point is this: you charge me with blasphemy based on my use of the title “Son of God”; yet your own Scriptures apply the same term to magistrates in general. If those who hold a divinely appointed office can be considered “gods,” how much more can the One whom God has chosen and sent (verses 34-36)?



In contrast, we have the serpent’s lie to Eve in the Garden. His statement, “your eyes will be opened, and you will be like God, knowing good and evil” (Genesis 3:5), was a half-truth. Their eyes were opened (verse 7), but they did not become like God. In fact, they lost authority, rather than gaining it. Satan deceived Eve about her ability to become like the one true God, and so led her into a lie. Jesus defended His claim to be the Son of God on biblical and semantic grounds—there is a sense in which influential men can be thought of as gods; therefore, the Messiah can rightly apply the term to Himself. Human beings are not “gods” or “little gods.” We are not God. God is God, and we who know Christ are His children.

“Een moderne koning zou, in de geest van de hedendaagse samenleving, zich bewust moeten zijn van het seculiere karakter van Nederland wanneer hij in het openbaar spreekt.” Dirkjan Tijs en Arnout Maat betogen in hun artikel op ThePostOnline, dat de Nederlandse monarch het woord ‘God’ niet in de mond moet nemen wanneer hij de troonrede uitspreekt. De heren wijzen op de scheiding tussen kerk en staat, maar vergeten dat dit principe nergens in de Nederlandse wet is opgenomen. Wel kan op basis van artikel 1 en 6 van de grondwet – anti-discriminatie en vrijheid van godsdienst en levensovertuiging – een scheiding van kerk en staat de facto worden uitgevoerd.

Bovendien begrijpen de heren het principe van scheiding tussen kerk en staat niet helemaal. Het gaat in dit principe om een organisatorische en bestuurlijke scheiding. Dat wil zeggen dat de overheid zich op het bestuurlijke en organisatorische vlak niet bemoeit met de kerk, en vice versa. Ook inhoudelijk bemoeit de overheid zich niet met geloof, wijzend op het zesde artikel van de grondwet. Dit alles waarborgt godsdienst vrijheid enerzijds en anderzijds een theocratie.

Maar het principe van de scheiding tussen kerk en staat is is geen scheiding tussen politiek en religie. Die kennen wij in Nederland niet. Godzijdank zou ik willen zeggen. Hoewel ik zelf geen religie aanhang, ben ik wel blij dat religie, net als mijn levensovertuiging, deel mag en kan uitmaken van onze pluriforme samenleving – de heren Tijs en Maat kwalificeren de Nederlandse samenleving als ‘het religieus verdeelde volk’ – en de publieke ruimte waarin wij samenleven. Waarom mag een staatshoofd of een politicus wel verwijzen naar theorieën gebaseerd op het werk van Karl Marx, Adam Smith, Johan Rudolph Thorbecke of Alexis de Tocqueville, maar niet naar de grote, zo niet de grootste, inspiratiebron van de mensheid, God?

 

Symbolisch

Daarnaast verwijzen Tijs en Maat naar de symbolische functie van het staatshoofd. De heren weten zeer goed dat het staatshoofd niet gaat over de tekst van de troonrede. Het is dus aan het kabinet om God buiten de deur te houden, niet aan het staatshoofd. Maar dan nog, als het staatshoofd en de troonreden symbool zijn – de plannen van de troonrede zijn immers toch al uitgelekt en iedereen haast zich na de troonrede naar de Minister van Financiën met zijn koffertje – waarom kunnen Tijs en Maat ‘God’ niet als een symbool zien? Het woord God is neutraal. Dat kan Jehovah, Allah, God of Jezus zijn. Of misschien wel iets hogers, iets groters, iets belangrijkers dan miljoenennota’s of hoedjes. Dat kan ieder mens voor zichzelf invullen, dat staat hem immers vrij in onze samenleving en democratische rechtsstaat.

In een samenleving waar verschillende geloven worden beleden is het doodzwijgen van God en religie door de politiek juist een mogelijke steen des aanstoots waardoor sommige mensen zich vervreemd kunnen voelen van de politiek en de regering. Mensen zijn nu eenmaal gelovig. En geloof maakt een belangrijk deel van hun identiteit uit. Met de oproep in hun artikel ontkennen Tijs en Maat deze.

Hoe werkt de scheiding kerk en staat in Nederland?

 

Ieder heeft het recht zijn godsdienst of levensovertuiging, individueel of in gemeenschap met anderen, vrij te belijden, behoudens ieders verantwoordelijkheid volgens de wet. Artikel 6.1: Grondwet voor het Koninkrijk der Nederlanden van 24 augustus 1815

De scheiding tussen kerk en staat is niet hetzelfde als een scheiding tussen religie en politiek. Bovenstaand gedeelte is in het verleden in de Grondwet opgenomen toen er vrij veel frictie was in Nederland tussen de katholieken en protestanten. Dit gedeelte van de Grondwet geeft aan dat de wet boven de kerk, en religie, staat. Het belangrijke punt hierbij is, is dat de kerk de wet niet voorschrijft - wat in vroeger tijden wel anders was.

Er zijn mensen die het grotendeels eens zijn met een geloof, of in ieder geval vanuit hun geloofsovertuiging een visie op Nederland hebben. Dat kan in Nederland, wij hebben een democratie, en als er tijdens verkiezingen genoeg mensen op jouw en je partij stemmen kun je dat uitdragen zolang het in overeenstemming met de wet is.

Catholics and Lutherans mark 500th anniversary of Reformation

The Pontifical Council for Promoting Christian Unity and the Lutheran World Federation issue a joint statement, giving thanks for the spiritual and theological gifts received through the Reformation and recalling the commemorative events that have taken place over the past year.

 

 

October 31st 2017 (i.517) marks the 500th anniversary of the day on which German theologian Martin Luther published his 95 theses, setting in motion the events of the Protestant Reformation.

To mark the occasion, the Pontifical Council for Promoting Christian Unity and the Lutheran World Federation on Tuesday issued a joint statement, giving thanks for the spiritual and theological gifts received through the Reformation and recalling the commemorative events that have taken place over the past year.

Exactly one year ago, Pope Francis travelled to the Swedish cities of Lund and Malmo to take part in a joint commemoration of the Reformation alongside leaders of the Lutheran World Federation. A moving liturgy in the ancient Lund cathedral and a joyful celebration of young people in Malmo arena focused on asking forgiveness for the sins of past centuries, while also celebrating the progress of the last fifty years and pledging to step up joint efforts in the service of those most in need.

Commitment to continue the ecumenical journey

One year on, today’s statement recalls those historic events, in particular the commitment by Pope Francis and former LWF president Bishop Munib Younan to continue the ecumenical journey.

The statement says the shared journey of the past fifty years has resulted in “the removal of prejudices, the increase of mutual understanding and the identification of decisive theological agreements”.

While Catholics and Lutherans can still not share at the Eucharistic table, the two Churches acknowledge their “joint pastoral responsibility to respond to the spiritual thirst and hunger of our people to be one in Christ “.

New insights into Reformation

Commemorating the Reformation together in many countries around the world, the statement says, has allowed Lutherans and Catholics new insights into events of the 16th century which led to their separation. Noting the theological progress that was made through the Joint Declaration on the Doctrine of Justification, the statement says growing communion and shared service are a sign of hope for the world of today to overcome divisions and fragmentation.

The statement concludes with a commitment to continue the journey towards unity, guided by God’s Spirit, in the knowledge that “what we have in common is far more than that which still divides us”.

Joint Statement by the Lutheran World Federation and the Pontifical Council for Promoting Christian Unity on the conclusion of the year of the common commemoration of the Reformation, 31st October 2017

On 31st of October 2017, the final day of the year of the common ecumenical Commemoration of the Reformation, we are very thankful for the spiritual and theological gifts received through the Reformation, a commemoration that we have shared together and with our ecumenical partners globally. Likewise, we begged forgiveness for our failures and for the ways in which Christians have wounded the Body of the Lord and offended each other during the five hundred years since the beginning of the Reformation until today.

We, Lutherans and Catholics, are profoundly grateful for the ecumenical journey that we have travelled together during the last fifty years. This pilgrimage, sustained by our common prayer, worship and ecumenical dialogue, has resulted in the removal of prejudices, the increase of mutual understanding and the identification of decisive theological agreements. In the face of so many blessings along the way, we raise our hearts in praise of the Triune God for the mercy we receive.

On this day we look back on a year of remarkable ecumenical events, beginning on 31st October 2016 with the joint Lutheran - Catholic common prayer in Lund, Sweden, in the presence of our ecumenical partners. While leading that service, Pope Francis and Bishop Munib A. Younan, then President of the Lutheran World Federation, signed a joint statement with the commitment to continue the ecumenical journey together towards the unity that Christ prayed for (cf. John 17:21). On the same day, our joint service to those in need of our help and solidarity has also been strengthened by a letter of intent between Caritas Internationalis and the Lutheran World Federation World Service.

Pope Francis and President Younan stated together: “Many members of our communities yearn to receive the Eucharist at one table, as the concrete expression of full unity. We experience the pain of those who share their whole lives, but cannot share God’s redeeming presence at the Eucharistic table. We acknowledge our joint pastoral responsibility to respond to the spiritual thirst and hunger of our people to be one in Christ. We long for this wound in the Body of Christ to be healed. This is the goal of our ecumenical endeavours, which we wish to advance, also by renewing our commitment to theological dialogue.”

Among the blessings of this year of Commemoration is the fact that for the first time Lutherans and Catholics have seen the Reformation from an ecumenical perspective. This has allowed new insight into the events of the sixteenth century which led to our separation. We recognize that while the past cannot be changed, its influence upon us today can be transformed to become a stimulus for growing communion, and a sign of hope for the world to overcome division and fragmentation. Again, it has become clear that what we have in common is far more than that which still divides us.

We rejoice that the Joint Declaration on the Doctrine of Justification, solemnly signed by the Lutheran World Federation and the Roman Catholic Church in 1999, has also been signed by the World Methodist Council in 2006 and, during this Commemoration Year of the Reformation, by the World Communion of Reformed Churches. On this very day it is being welcomed and received by the Anglican Communion at a solemn ceremony in Westminster Abbey. On this basis our Christian communions can build an ever closer bond of spiritual consensus and common witness in the service of the Gospel.

We acknowledge with appreciation the many events of common prayer and worship that Lutherans and Catholics have held together with their ecumenical partners in different parts of the world, as well as the theological encounters and the significant publications that have given substance to this year of Commemoration.

Looking forward, we commit ourselves to continue our journey together, guided by God's Spirit, towards the greater unity according to the will of our Lord Jesus Christ. With God’s help we intend to discern in a prayerful manner our understanding on Church, Eucharist and Ministry, seeking a substantial consensus so as to overcome remaining differences between us. With deep joy and gratitude we trust “that He who has begun a good work in [us] will complete it until the day of Jesus Christ” (Phil 1:6).

Het Tweede Verdrag van Parijs werd op 20 november 1815 in Parijs ondertekend. Na de definitieve nederlaag van Napoleon in de Slag bij Waterloo legden de bondgenoten Frankrijk op hoe het bestuurd moest worden.

Het Congres van Wenen of Weens Congres werd na de val van Napoleon in 1814 en 1815 gehouden door de overwinnende mogendheden Pruisen, Oostenrijk, Rusland en het Verenigd Koninkrijk met als doel de Europese vrede op effectieve wijze gezamenlijk te regelen en vast te leggen. Het congres besloot over de kwestie van de naoorlogse grenzen, de invoering van grondwetten en de oprichting of opheffing van middelgrote staten.[1]

Situering

Algemeen

Een staatkundige herordening van Europa was nodig, want de Franse Revolutie en vooral de daaropvolgende napoleontische oorlogen hadden die kaart grondig hertekend. Zo was het eeuwenoude Heilige Roomse Rijk verdwenen, en had Frankrijk de confederale gebieden van de Oostenrijkse Nederlanden en de Republiek der Zeven Verenigde Nederlanden geannexeerd, net als de Franstalige delen van Zwitserland en het gebied van Duitsland ten westen van de Rijn. Hoewel sommige conservatieve aristocraten de 'vooroorlogse' situatie inclusief grenzen weer wilden herstellen zag de meerderheid der verzamelde staatslieden de noodzaak in van een staatkundige vereenvoudiging van de kaart van Europa en een grondige sanering van de wirwar van heerlijke rechten. Napoleon had veel staatjes en staten al samengevoegd en het veelal plaatselijke recht vereenvoudigd en nationaal gelijkgeschakeld. En ook zijn invoering van een betere administratie van bijvoorbeeld de burgerlijke stand wilde men handhaven. Dit waren allemaal 'praktische' verbeteringen waar iedereen de waarde van kon inzien maar de oorspronkelijke idealen van de Franse Revolutie, Liberté, egalité et fraternité (vrijheid, gelijkheid en broederschap), overigens door de autoritaire Napoleon later in zijn loopbaan ook met voeten getreden, wilden de verzamelde aristocraten natuurlijk niet overnemen, want dat hield een aantasting van hun aloude rechten en privileges in.

Het Congres, waarbij de Oostenrijkse kanselier Klemens von Metternich grote invloed had op het verloop ervan, begon in september of oktober 1814 (de bronnen verschillen over de aanvangsdatum) en eindigde op 9 juni 1815 met het voorlezen van de besluiten. Toch kan men aan dit Congres geen duidelijk begin en eind toekennen. Het was eerder een verzamelnaam voor een proces dat begon in de zomer van 1812 en in 1822 werd afgerond met als gemeenschappelijk element dat iedere deelnemer doodsbang was door de andere buitenspel te worden gezet in een strijd om gebied, macht en invloed. Het bijzondere aan dit congres kwam hierop neer dat slechts één plenaire zitting plaatsvond en dat de discussies en de beslissingen elders werden genomen, eerder in de marge. Tijdens dit congres kwamen twee grote tegenstellingen naar boven: het wederzijdse wantrouwen tussen het Verenigd Koninkrijk en Rusland, alsmede de rivaliteit tussen Pruisen en Oostenrijk. Daarbij trachtte het overwonnen Frankrijk opnieuw een rol op het eerste plan te spelen.

Volgens Emmerich Joseph von Dalberg, een Duitse diplomaat in Franse dienst, getuigde het Congres van een totale beginselloosheid en werden de zaken naar het einde toe steeds willekeuriger afgehandeld of afgedaan met instemmend geknik. Hij schreef: "Wij ronden nu de treurige zaken af; het resultaat van dit alles kon niet kleingeestiger zijn." De ontsnapping eind februari 1815 van Napoleon van Elba en zijn verdere opmars naar Parijs veranderde de politieke en militaire situatie, waardoor de urgentie om tot een afronding te komen heel groot werd. Congressecretaris Friedrich von Gentz werd gemaand vlug een verslag van de handelingen van het congres op te stellen. Dit werd een slotakte van 121 artikelen, met alle congresbesluiten en overeenkomsten genomen vanaf de aanvang tot begin juni 1815. De slotakte was klaar op 8 juni en werd de dag daarop in de ontvangstzaal van de Hofburg van Wenen plechtig voorgelezen in aanwezigheid van alle partijen. Op enkele uitzonderingen na (kardinaal Ercole Consalvi en de Spaanse vertegenwoordiger de Markies van Labrador), gaven alle gedelegeerden op 26 juni 1815 de goedkeurende handtekening. Inmiddels, op 18 juni, was Napoleon definitief verslagen in de Slag bij Waterloo.

In aanvulling op deze slotakte werd op 20 november 1815 het Verdrag van Parijs ondertekend door de vijf grote mogendheden: Frankrijk, Oostenrijk, Rusland, het Verenigd Koninkrijk en Pruisen.

Het Congres danst, maar komt niet vooruit[2]

De gezanten met hun entourage van raadgevers en bedienden vormden een bont gezelschap van enkele duizenden personen, waarbij de Oostenrijkers erop toezagen dat hun hoge gasten niets tekortkwamen tijdens hun verblijf in Wenen. De vele bals en partijen ontlokten Charles-Joseph van Ligne de opmerking:

"Hoe loopt het Congres? Het Congres loopt niet, het danst!"

In een brief aan Talleyrand van 1 november 1814 schreef Ligne:

"Man schreibt mir das Wort zu: "Der Kongress tanzt, aber er kommt nicht vorwärts." Es sickert auch nichts durch als der Schweiß dieser tanzenden Herren. Ich glaube auch gesagt zu haben: "Dies ist ein Kriegskongress, kein Friedenskongress."[3]

Een aantal waarnemers van het Congres beklaagde zich over het heersende immobilisme, dat te vergelijken zou zijn met een Poolse landdag[bron?]. Velen kwamen ook onder de indruk van de tentoongespreide pracht en grandeur. De algemeen secretaris Friedrich von Gentz beschreef dit gebeuren zeer beeldend in een brief van 27 september 1814 maar beklaagde er zich ook over dat er weinig vooruitgang geboekt werd:

"Die Stadt Wien bietet gegenwärtig einen überraschenden Anblick dar; alles was Europa an erlauchten Persönlichkeiten umfasst ist hier in hervorragender Weise vertreten. Der Kaiser, die Kaiserin und die Großfürstinnen von Rußland, der König von Preußen und mehrere Prinzen seines Hauses, der König von Dänemark, der König und der Kronprinz von Bayern, der König und der Kronprinz von Württemberg, der Herzog und die Prinzen der Fürstenhäuser von Mecklenburg, Sachsen-Weimar, Sachsen-Coburg, Hessen usw., die Hälfte der früheren Reichsfürsten und Reichsgrafen, endlich die Unzahl von Bevollmächtigten der großen und kleinen Mächte von Europa - dies alles erzeugt eine Bewegung und eine solche Verschiedenheit von Bildern und Interessen, dass nur die außerordentliche Epoche, in der wir leben, etwas Ähnliches hervorbringen konnte. Die politischen Angelegenheiten, welche den Hintergrund dieses Bildes sind, haben indessen noch keinen wirklichen Fortschritt gebracht."[4]

De Pruisische veldmaarschalk Blücher omschreef de onderhandelingen aldus:

"Der Kongress gleicht einem Jahrmarkt in einer kleinen Stadt, wo jeder sein Vieh hintreibt, es zu verkaufen und zu vertauschen."[5]

Sommige historici zijn evenwel de mening toegedaan dat het Congres met al het feestgedruis ook zijn hoofddoel, namelijk een kader te scheppen voor een Europese vredesregeling, toch uiteindelijk gerealiseerd heeft. Tot aan de tijd van de Italiaanse en Duitse eenwording, ongeveer 40 jaar later rond 1860, waren er geen grote oorlogen meer in Europa en bleven de toen vastgestelde staatkundige grenzen vrijwel ongewijzigd. Met 1 markante uitzondering. De Belgische revolutie in 1830, met het daarop volgende Verdrag van Londen in 1839, had de oprichting van twee nieuwe staten tot gevolg: België en Luxemburg.

Leidende gedachte

  • Restauratie oude en invoering nieuwe vorstenhuizen, honorering dynastieke wensen van de Ancien Régimes. Het Congres van Wenen had de sociale verworvenheden van de Franse Revolutie in alle landen ongedaan gemaakt. Geen volksvertegenwoordiging en geen vertegenwoordiging van de naties. Bijeenkomsten zonder burgerlijke vertegenwoordiging.
  • Strategische overwegingen in verband met machtsevenwicht tegen de "universele monarchie". Niet eeuwige vrede maar orde. Verschuiving van grenzen: verplaatsing van volkeren, alleen uit strategische overwegingen.
  • Tegen liberalisme en nationalisme.

Resultaten

 
Nieuwe kaart van Europa na het Congres
  • Koloniale bezittingen:
    • De Nederlandse koloniën op de Guiana's werden tijdens de Bataafse Periode bezet door de Britten omdat de Republiek, als vazalstaat van Frankrijk, in oorlog was met het Verenigd Koninkrijk. Formeel werden de koloniën door de Britse Kroon in bescherming genomen, namens Prins Willem V van Oranje-Nassau die naar Engeland was gevlucht. Na de Napoleontische oorlogen in 1814 werd op de Conventie van Londen de helft van het toenmalige Nederlands-Guiana van Nederland afgenomen. In deze drie koloniën (Demerara, Essequibo en Berbice) hadden de Britten de laatste decennia veel geïnvesteerd. De Nederlandse planters in het gebied behielden hun oude rechten en de meesten bleven in de kolonie wonen. Niet alleen Essequibo, Demerara en Berbice, in 1831 samengevoegd tot Brits-Guiana, werden afgestaan. Ook de Kaapkolonie en Ceylon werden afgestaan aan het Verenigd Koninkrijk. In ruil voor deze koloniën werd de voormalige Nederlandse Republiek uitgebreid met de vroegere Oostenrijkse Nederlanden en het Prinsbisdom Luik.
  • Andere agendapunten en besluiten in de marge genomen:
    • Pruisen, Oostenrijk en Rusland sloten de Heilige Alliantie die zou tussenkomen bij een revolutionaire beweging in Europa; zo kon men de op het Congres overeengekomen besluiten garanderen. Rusland kwam in 1830 inderdaad tussen toen de Poolse Novemberrevolutie van 1830 uitbrak. Deze opstand zou tsaar Nicolaas I verhinderen te interveniëren in de Belgische Opstand.
    • Zijdelings kwam op het congres ook de afschaffing van de slavenhandel en de daaruit voortkomende slavernij aan bod. Dit onderwerp werd door interne meningsverschillen tussen enerzijds Groot-Brittannië en Spanje/Portugal, verdaagd tot de Griekse kalenden. Het bleef bij plechtige verklaringen waarin de slavenhandel weerzinwekkend en immoreel genoemd werd. De staatslieden verklaarden plechtig de handel te willen uitroeien en beloofden dat doel met ijver en volharding te zullen nastreven.
    • De Commissie Protocollaire Voorrang hing het gelijkheidsbeginsel aan en besloot dat alleen op basis van de accreditatiedatum voorrang aan diplomaten mocht worden verleend. Daarbij kregen bondgenoten of grootmachten geen bijzondere privileges. De pauselijk legaat kreeg de absolute voorrang. De volgorde bij het ondertekenen van verdragen werd door de commissie geregeld. Het eerst door de vorst ondertekende verdrag moest in zijn kanselarij bewaard worden. De anderen tekenden vervolgens in volgorde van troonsbestijging of bij republieken, in volgorde van verkiezing. Deze regels bepalen nog steeds het diplomatieke protocol.
    • De Commissie Vrije Doorvaart op Internationale Rivieren met als commissieleden alle direct betrokken riviermachten, besprak het verkeer op de grote rivieren als de Rijn, de Maas, de Neckar, de Main en de Schelde. Er werd besloten een permanente internationale commissie in het leven te roepen met zetel te Mainz of Frankfurt die zich over alle toekomstige geschillen zou buigen. Men legde tolgeld, heffingen, in- en uitvoerrechten vast.
    • Het statuut van de Soevereine Militaire Hospitaalorde van Sint-Jan van Jeruzalem en Malta in Rusland in relatie met het sinds 1800 door de Britten bezette Malta kwam ook aan bod. De Orde van Malta ving echter bot en verloor haar al haar rechten op het eiland Malta.
    • Het congres stond ook even stil bij een petitie van Karl Bertuch, stichter van de Vereinigung der deutschen Buchhändler, over de bescherming van het literaire auteursrecht. Hij drong aan op een regelgeving om de praktijk van het overhand toenemend kopiëren van boeken wettelijk te regelen.

Informele diversen

Andere, wat informele, besluiten en opvallende punten waren:

  • het sindsdien houden van een Congres wanneer er een conflict dreigde (Congresstelsel) om aldus de situatie via overleg te regelen in plaats van een gewapend conflict. Tot aan de Krimoorlog (1853 - 1856) werkte dit systeem redelijk goed en waren er geen grotere onderlinge oorlogen in Europa.
  • het direct weer opnemen van Frankrijk in de besluitvorming. Ook werd Frankrijk grotendeels hersteld binnen de grenzen van voor de revolutie. Dit voorkwam in grote mate dat er in Frankrijk ernstige rancune zou ontstaan over het uiteindelijke verlies van Napoleon. Dit in tegenstelling tot het Verdrag van Versailles (1919) waarbij het verslagen Duitse Keizerrijk geen enkel zeggenschap had bij de onderhandelingen over de vredesvoorwaarden en waar de Duitse macht bovendien werd ingeperkt. Door de resulterende grote onvrede hierover in Duitsland en het daarop volgende Duitse revanchisme (het breed gedragen streven om 'het onrecht van het Diktaat van Versailles' ongedaan te maken) was dit een belangrijke factor in de opkomst van Adolf Hitler.
  • het negeren van nationalisme en liberalisme. Herstel van oude structuren en herordening van Europa was het belangrijkst. Landen werden zomaar verkaveld of samengevoegd zonder rekening te houden met nationale gevoelens, maar puur uit strategisch oogpunt, machtsbalans en de belangen en wensen van vorsten.[bron?]
  • het niet inzien dat de krachten die in de Franse Revolutie waren losgebarsten ook elders boven zouden kunnen komen.

Nasleep en gevolgen

Door het Congres kwam Europa tot stilstand. De gerestaureerde orde zou echter niet voor onbeperkte tijd stand houden. De ideeën van de Franse Revolutie gevoed door de Verlichting, hadden overal al wortel geschoten, en leidden tot staatkundige veranderingen. De ontbinding van het Osmaanse Rijk werd erdoor bevorderd, omdat de Franse ideeën in de Osmaanse gebieden Servië, Griekenland en Roemenië wortel schoten. Voor Oostenrijk gold hetzelfde. Het Verenigd Koninkrijk der Nederlanden viel in 1830 uiteen, terwijl in Servië opstanden uitbraken. Dit vormde de eerste barst in de nieuwe constellatie. Liberale revoluties in 1830 en vooral in het revolutiejaar 1848 hadden in heel Europa grote gevolgen. Uiteindelijk zouden de Bourbons plaats maken voor het Tweede Franse Keizerrijk. Omstreeks 1860 kwam er een Italiaanse eenheidsstaat tot stand. De Duitse Bond hield het uit tot 1866, maar Pruisen bleek in Noord-Duitsland zo dominant te zijn, dat het de keten van gebeurtenissen in kon zetten die leidden tot de oprichting van het Duitse Keizerrijk in 1871.
Het Weens Congres was verder een poging om een status quo tussen vier grote Europese staten (de overwinnaars van Napoleon) voor een eeuw vast te leggen. Dit leidde ertoe dat de expansiedrang van Britten en Fransen zich zou richten op kolonisering van Afrika en Azië (zie Imperialisme).

Dit was ook zo met het eengemaakte Duitsland na 1871, maar niet met het Habsburgse Rijk (Oostenrijk), dat nooit kolonies had.

Door het Weense Congres kreeg het continentale Europa niet alleen een ideologie opgelegd, afgeleid van de belangen van vier grote mogendheden, maar het beïnvloedde indirect alles wat zich nadien in Europa afspeelde, waaronder het militant nationalisme, bolsjewisme, fascisme, de grote militaire conflicten van de 20ste eeuw tot het ontstaan van de Europese Unie.[bron?]

Deze personen hadden elk hun soms rancuneuze onhebbelijkheden. Napoleon, nog steeds een factor van belang, vocht voor behoud van zijn troon en wilde een dynastie vestigen. Tsaar Alexander I had niet door dat hijzelf, overtuigd van zijn goddelijke roeping, een bedreiging vormde voor een wereldbeeld dat hij voorstond. Klemens von Metternich, een volleerd manipulator, trachtte de anderen te overtuigen van zijn visie voor een veiligere wereld. Daarnaast Talleyrand die na het debacle van Napoleon in Rusland, Frankrijks meubelen probeerde te redden. Ten slotte Castlereagh die arrogant en ingegeven door eigenbelang, bestaande landen in stukken hakte en zijn inwoners als te verschuiven vee behandelde.[bron?]

16. Kerk en staat

Natuurlijke spanning

Het kerkelijk leven speelt zich af op het grondgebied van een staat en de kerkleden zijn meestal burgers van die staat. Dat zet kerk en staat onontkoombaar in een bepaalde relatie tot elkaar.
Wanneer die verhouding geplaatst wordt tegen de achtergrond van het seculariseringsproces van de moderne tijd, zijn velen geneigd die verhouding onbelangrijk te vinden. Men ontleent tenminste aan het seculariseringsproces nogal eens een excuus om af te zien van een goede omgang en een zinvolle samenwerking tussen kerk en staat. Maar zo gemakkelijk komen we niet van de vraag naar de verhouding tussen kerk en staat af.
Aan de verhouding tussen kerk en staat ligt immers ten grondslag de verhouding tussen religie en politiek. Die verhouding staat altijd min of meer onder spanning, omdat religie een publieke aangelegen­heid is en de kerk een politieke factor, terwijl anderzijds politiek en staat mede religieus bepaald zijn.
Dat verklaart waarom in verleden en heden kerk en staat probeer­den vat op elkaar te krijgen en als dat niet lukte elkaar uit te sluiten. Niet zozeer omdat kerk en staat geen raad weten met eikaars auto­nomie en eigen plaats in de samenleving. De problemen die daaruit voortvloeien kunnen door afspraken worden opgelost. Maar kerk en staat hebben vanwege hun plaats in de maatschappij een zekere claim op elkaar. De kerk leert dat ook de staat onderworpen is aan Gods geboden en van nature sympathiek hoort te staan tegenover de kerk en zonodig als haar beschermheer moet optreden. Maar de staat voelt zich bedreigd door een gemeenschap in zijn boezem, die zelfstandig denkt en optreedt, en ziet liefst een kerk die voor hem bidt en de gelovigen onderworpenheid aan de overheid leert.
Als kerk en staat elkaar als een bedreiging ervaren, zal de staat pro­beren de kerk ongevaarlijk te maken door haar als staatskerk in te kapselen in het staatsbestel of door haar te vervolgen. En de kerk zal proberen in een kerkstaat de staat in dienst te nemen als houthakker en waterputter of anders de staat af te schrijven als hoer van Babylon en werk van de duivel. De spanning kan worden afgeleid door een verbond tussen troon en altaar. De staat verleent dan aan de kerk de door haar verlangde diensten door te fungeren als voedsterheer van de kerk en door met zijn sterke arm te onderdrukken al wat de kerk bedreigt. In ruil daar­voor zegent de kerk de wapens van de staat en doet zij elke revoluti­onaire beweging in de ban.
In al deze gevallen wordt uitgegaan van een valse tegenstelling tus­sen kerk en staat en wordt vergeten dat zij kinderen zijn van een Vader.

 

Artikel 36 N.G.B.

In de Nederlandse Geloofsbelijdenis is geprobeerd kerk en staat in de juiste verhouding tot elkaar te stellen.
Uitgangspunt is de goddelijke oorsprong, zowel van de staat als van de kerk. De kerk is gegeven met het zijn van Christus (art. 27: ‘want Christus is een eeuwig Koning, die niet zonder onderdanen kan zijn.’). De staat is door God ingesteld (art. 36: ‘opdat de ongebondenheid der mensen bedwongen wordt en alles met goede orde onder hen toegaat.’).
In artikel 36 wordt zelfs aan de staat opgedragen ‘alle afgoderij en valse godsdienst te weren en uit te roeien (en) het rijk van de anti­christ te vernietigen’.
Vastgesteld kan worden dat deze zinsnede uit artikel 36 niet beant­woordt aan de werkelijkheid. Dat kan daaraan geweten worden, dat de staat niet is wat hij moet zijn: een christelijke staat. Anderzijds kan worden gezegd dat de staat, gezien zijn aard en functie, het on­derscheidingsvermogen mist om te doen wat artikel 36 in de aange­haalde zinsnede zegt van de staat te verwachten. Kan de staat kiezen uit de veelheid van godsdienstige bewegingen en geestelijke stromingen?
Deze overwegingen brachten de generale synode van de Gerefor­meerde Kerken in Nederland in 1905 ertoe om de woorden ‘alle af­goderij en valse godsdienst te weren en uit te roeien, het rijk van de anti-christ te vernietigen’ uit artikel 36 te schrappen. Alleen de kerk is in staat de heilige Schrift uit te leggen en te onderscheiden tussen ware en valse religie.
Maar als de staat het vermogen mist om de heilige Schrift uit te leggen, dan kan hij toch in geen enkel opzicht functioneren? Hier ligt een van de bestaansgronden van de theologische faculteit van de rijksuniversiteiten. De aanwezigheid en het functioneren daarvan naar de staat toe, maakt de staat nog niet tot een christelijke staat. Maar wel wordt zo duidelijk, dat de kerk niet het monopolie van de uitleg van de heilige Schrift heeft. En ook dat de staat een eigen plaats heeft in de geschiedenis van de komst van Gods koninkrijk.

 

‘De overheid en de kerk dienen beide in het Koninklijke plan Gods, maar zij dienen daarin niet op dezelfde wijze. De kerk predikt Gods heil. De overheid ordent het uiterlijke leven naar dit heil. Zij luistert daarbij naar de prediking der kerk maar handelt in zelfstandige ver­antwoordelijkheid jegens God. Eenzelfde openbaring Gods is het licht op het pad der kerk en op het pad der overheid, met dien verstande dat de terreinen onderscheiden blijven en noch de kerk heerse over de overheid noch de overheid in de kerk.’ (Fundamenten en Perspec­tieven van belijden, vastgesteld door de generale synode van de Ne­derlandse Hervormde Kerk, 19 mei 1949, artikel 16.)

 

Scheiding van kerk en staat

 

In Nederland is gekozen voor de scheiding van kerk en staat. Niet in die zin, dat ze niets met elkaar te maken hebben, maar zo, dat kerk en staat elkaar erkennen als autonome grootheden in hun eigenheid. De staat mag niet ingrijpen in de interne verhoudingen van de kerk en de kerk heeft geen bevoegdheden in staatszaken.
Dat betekent allereerst dat kerk en staat zelf onafhankelijk van el­kaar hun eigen wetten en regels vaststellen en voorts dat zij onafhan­kelijk van elkaar functioneren. De staat is immers een door een soevereine regering bestuurde politieke grootheid die alle inwoners van het land omvat. De kerk is een zichzelf besturende religieuze grootheid, een gemeenschap van gelovigen die zich vrijwillig aan el­kaar verbonden hebben. De staat kan de naleving van zijn wetten af­dwingen met geweld. Het gezag van de kerk is geestelijk.
Daaruit mogen we geen absolute tegenstelling afleiden. Kerk en staat staan als priester en koning onder het appèl van de profeten opdat zij beide tot zegen zijn voor de samenleving. Maar dat neemt niet weg dat zij hun dienst alleen maar goed kunnen verrichten als zij ten opzichte van elkaar hun handen vrij houden. Want een kerkstaat leidt tot geloofsdwang en een staatskerk tot vormendienst, en in bei­de gevallen worden zowel kerk als staat ontwricht.
De scheiding van kerk en staat in Nederland vloeit voort uit de in de Nederlandse grondwet vastgelegde vrijheid van godsdienst. Arti­kel 6 van de grondwet luidt:

1. Ieder heeft het recht zijn godsdienst of levensovertuiging, individueel of in gemeenschap met anderen, vrij te belijden, behoudens ieders verantwoordelijk­heid volgens de wet.
2. De wet kan terzake van de uitoefening van dit recht buiten gebouwen en besloten plaatsen regels stellen ter bescherming van de gezondheid, in het belang van het verkeer en ter bestrijding of voorkoming van wanordelijkheden.

 

Vrijheid van godsdienst houdt in dat de burgers van een staat de vrij­heid hebben om al dan niet tot een kerk te behoren en zich aan te sluiten bij de kerk van hun keuze, zonder dat de overheid daartoe aandringt of daar consequenties uit trekt. Het houdt tevens de moge­lijkheid in van een verscheidenheid aan godsdiensten en een veelheid van kerken in een land. Aan de andere kant betekent het ook dat de overheid zich onthoudt van bemoeienis met de organisatie van de kerken (art. 2 Boek 2 Burgerlijk Wetboek).
Toch kan het voorkomen, dat kerken of leden van kerken de tus­senkomst van de burgerlijke rechter inroepen om recht te spreken in kerkelijke conflicten. De rechter zal er zich dan toe beperken na te gaan of de regels van de betrokken kerk zelf goed zijn toegepast, echter zonder zich uit te spreken over de kwaliteit van die regels op zich. Ook zal de rechter terughoudend zijn in de interpretatie van die regels en het maken van analogieën Het kerkelijk recht is im­mers voor de burgerlijke rechter vreemd recht waar hij als burgerlij­ke rechter buiten staat en waarin hij geen rol speelt zoals in het Ne­derlandse recht.

 

Bescherming van de kerk door de staat

Maar met deze terughoudende opstelling van de staat tegenover de kerk en haar recht zijn we er niet. De vrijheid van godsdienst heeft alleen zin als de burgers van de staat ook de mogelijkheid hebben om de godsdienst waartoe men behoren wil aan te hangen. Vrijheid van godsdienst houdt dus in dat er door de staat garanties worden gege­ven tegen belemmering van de vrijheid van godsdienst.
Die kunnen bijvoorbeeld ontstaan door sociaal-economische facto­ren, omstandigheden waar de gelovigen zelf niets aan kunnen veran­deren. De staat echter heeft meer dan eens de middelen om corrigerend op te treden, bijv. door het geven van subsidies of faciliteiten. Daar­mee treedt de staat nog niet op als bevorderaar van de godsdienst. Maar wel kan op deze manier gezorgd worden dat een grondrecht geen wassen neus wordt. Als voorbeelden zijn te noemen: subsidiëring van kerkbouw, organisatie en bezoldiging van de geestelijke ver­zorging in de krijgsmacht, godsdienstonderwijs op de openbare school, subsidiering van het onderhoud van monumentale kerkgebouwen, verstrekking van gegevens van de burgerlijke stand ten behoeve van de kerkelijke ledenadministratie enz.
Anders ligt het met betaling door de staat van (een bijdrage aan) predikantstractementen (de zgn. ‘zilveren koorde’). De oorsprong daarvan lag in de naasting door de staat van kerkelijke goederen waaruit de predikantstractementen werden gefinancierd. In 1983 is deze financiele bijdrage aan het kerkelijk leven uit ’s rijks schatkist afge­kocht, tegelijk met de aan bepaalde kerken verleende portvrijdom.
Weer anders ligt het met bepaalde voorrechten die de staat in het verleden aan de kerk heeft verleend in het recht van immuniteit. Im­muniteit maakte de kerk en de geestelijkheid onschendbaar tegen­over de staat. Als restanten daarvan zijn te beschouwen: de vrijstelling van predikanten en priesters en zij die daartoe worden opgeleid van de militaire dienstplicht, het respecteren van het ambtsgeheim van kerkelijke ambtsdragers, de onschendbaarheid van kerkdiensten en de vrijstelling van kerkgebouwen van de onroerend-goedbelasting.
Er is een tijd geweest dat kerkgebouwen en kerkhoven niet door justitiële ambtenaren betreden mochten worden om misdadigers te arresteren. Waar dat in Nederland het geval was, is dat reeds in de tijd van de reformatie afgeschaft. Kerkgebouwen zijn in Nederland geen asielplaats. Omdat de kerk in het verleden niet elke rover, moordenaar of ketter asiel verleende, moest zij zelf ten aanzien van asielzoekers een rechterlijke beslissing nemen. Zoiets is in deze tijd in ons land ondenkbaar, omdat er dan naast de Nederlandse recht­spraak een afzonderlijke kerkelijke rechtspraak voor niet-kerkelijke delicten zou bestaan en zo de eenheid van de rechtspraak in Neder­land doorbroken zou worden. Bovendien is in Nederland de recht­spraak zo georganiseerd, dat een rechtvaardige behandeling van iede­re rechtzoekende haalbaar is.
In kerkelijke kring wordt verschillend gedacht over de aanvaard­baarheid van overheidssteun bij het geven van gestalte aan het kerke­lijk leven. Deze steun kan gemakkelijk leiden tot afhankelijkheid, waardoor de staat macht krijgt over de kerk. Met het stopzetten van subsidie of het intrekken van verleende faciliteiten kan de staat de kerk in moeilijkheden brengen. Overheidssteun aan kerken zal dus gepaard moeten gaan met garanties ten aanzien van de onafhanke­lijkheid van de kerk. Die garantie zou kunnen liggen in het niet dan incidenteel laten zijn van overheidssteun. Maar bepaalde steun kan niet anders dan structureel zijn.
Overleg over de overheidssteun, de voorwaarden die daaraan zijn verbonden en andere zaken die zowel kerk als staat raken, wordt na­mens de kerken met de overheid gevoerd door het Interkerkelijk Con­tact in Overheidszaken (CIO), waarin 18 kerkgemeenschappen samenwerken.

 

De taak van de kerk ten opzichte van de staat

De scheiding van kerk en staat betekent niet dat de kerk geen bood­schap aan de staat heeft. Juridisch reikt de zeggenschap van de kerk niet verder dan de kring van haar leden. Maar het gezag van de kerk blijft niet tot deze kring beperkt. Wie zal Gods beloften en geboden betuigen voor mensen en machten (art. VIII hervormde kerkorde) als de kerk dat niet doet? Dat kunnen de gelovigen zijn, individueel of verenigd in politieke en maatschappelijke organisaties. Maar als de kerk-in-de-gelovigen verstek laat gaan of monddood gemaakt is, is de kerk als instituut geroepen haar getuigenis te doen uitgaan tot over­heid en volk (art. 130 gereformeerde kerkorde) om het onrecht tegen te spreken.
Dit spreken van de kerk kan betrekking hebben op de taak van de overheid, veranderingen in het strafrecht, conflicten bij afgrenzing van grondrechten, de vrijheid van onderwijs, huwelijks- en gezins­vragen, de sociale verzorging, het oorlogsvraagstuk enz. Dit spreken van de kerk kan de staat ongelegen komen en onwel­gevallig zijn. Des te meer reden is er om ervoor te zorgen dat de kerk vrij staat tegenover de staat en hem niet naar de ogen hoeft te zien.

 

Botsing van grondrechten

Vrijheid van godsdienst betekent niet dat de staat de kerk in alle op­zichten haar eigen gang kan laten gaan. De kerk mag door haar regels of door haar gedrag niet de in de grondwet vastgelegde grondrechten van de burgers van de staat aantasten of ook maar in gevaar brengen. Niemand mag, om maar een voorbeeld te noemen, tegen zijn wil in­geschreven staan in een kerkelijk ledenregister. Ook mag de kerk niet discrimineren.
Hier dreigt de botsing van grondrechten. Want wat door de een als discriminerend wordt ervaren, kan voor de ander voortvloeien uit zijn geloofsovertuiging. Denk maar aan de plaats van vrouwen en homosexuelen in de kerk. Daarbij moet worden bezien of de grondwet en de internationale verdragen, waarin de grondrechten zijn geformuleerd (het Handvest van de Verenigde Naties, het Ver­drag van Rome, het Internationale Verdrag inzake burgerrechten en politieke rechten van New York), beperkingsmogelijkheden van grondrechten i.v.m. collisie van grondrechten geven. Verder moet worden bezien wat het relatieve gewicht is van de door de grond­rechten beschermde belangen. En tenslotte of iemand die zich in zijn grondrechten voelt aangetast, zich vrijwillig of gedwongen begeven heeft in de situatie waarin dat gebeurt. Een homosexueel die van het avondmaal wordt geweerd, wordt niet door enige overheid gedwon­gen om te behoren tot de gemeente die hem op de genoemde wijze discrimineert.
Artikel 6 van de grondwet, waarin de vrijheid van godsdienst wordt geregeld, refereert aan ‘ieders verantwoordelijkheid volgens de wet’. De vrijheid van godsdienst kan en mag geen inbreuk maken op de algemene rechtsorde. Ik noem als voorbeelden: polygamie, het op wrede wijze slachten van dieren, het uitstrooien van de crematie-as op oppervlaktewateren. En om voor christenen dichter bij huis te blijven: godsdienstige manifestaties op de openbare weg door het houden van processies, straatprediking, boekverbranden. Te denken is ook aan voor anderen hinderlijk klokgelui.
Lid 2 van artikel 6 van de grondwet geeft de mogelijkheid van be­perking van het grondrecht van vrijheid van godsdienst. Deze is uit­gewerkt in de Wet Openbare Manifestaties van 1988. Het is vooral de plaatselijke overheid die tot taak heeft ervoor te zorgen dat de vrijheid van de een de vrijheid van de ander niet frustreert. Evenzeer zal de plaatselijke overheid de kerk beschermen tegen verstoring van de eredienst (art. 145-147a Wetboek van Strafrecht).
Tenslotte wil ik wijzen op artikel 449 van het Wetboek van Straf­recht waarin het de kerk wordt verboden een plechtigheid tot vol­trekking of bevestiging van een huwelijk te houden voordat het huwelijk is gesloten ten overstaan van de ambtenaar van de burgerlijke stand. De burgerlijke stand, ook die met betrekking tot echtverbintenissen, is een zaak van de staat en niet van de kerk.

 
Rechtspersoonlijkheid

Tot de vrijheid van de kerk behoort ook de mogelijkheid om aan het burgerrechtelijk rechtsverkeer deel te nemen en daartoe gebruik te maken van de voordelen die het hebben van rechtspersoonlijkheid biedt.
Het hebben van rechtspersoonlijkheid betekent voor een organisa­tie, dat zij dezelfde rechten en plichten kan hebben als een natuurlijk persoon zonder dat de natuurlijke personen die aan de rechtspersoon deelhebben in enig opzicht persoonlijk aansprakelijk gesteld kunnen worden.
Artikel 2 van Boek 2 van het Burgerlijk Wetboek luidt:

1. Kerkgenootschappen alsmede hun zelfstandige onderdelen bezitten rechtsper­soonlijkheid.
2. Zij worden geregeerd door hun eigen statuut, voor zover dit niet in strijd is met de wet.

 

 

Met ingang van 1 januari 1992 luidt dit artikel:

1. Kerkgenootschappen, alsmede hun zelfstandige onderdelen en lichamen waar­in zij zijn verenigd, bezitten rechtspersoonlijkheid.
2. Zij worden geregeerd door hun eigen statuut, voorzover dit niet in strijd is met de wet. Met uitzondering van artikel 5 gelden de volgende artikelen van de­ze titel niet voor hen; overeenkomstige toepassing is geoorloofd, voorzover deze te verenigen is met hun statuut en met de aard der onderlinge verhoudingen.

 

Het woord ‘kerkgenootschap’ is een term die de overheid bezigt om aan te duiden wat wij ‘kerk’ of ‘kerkgemeenschap’ noemen. Het woord stamt uit de tijd dat de kerk door de staat gezien werd als een vereniging (een ‘genootschap’) en het kerkelijk recht als verenigings-of genootschapsrecht.
Rechtspersoonlijkheid is niet iets dat door de overheid wordt ver­leend. Zij wordt voor verenigingen, vennootschappen en stichtingen door de overheid erkend als zij aan bepaalde voorwaarden voldoen, zoals: openbaarheid van statuten, duidelijkheid in de besluitvorming en de vertegenwoordiging, registratie bij een Kamer van Koophandel en Fabrieken.
Deze voorwaarden worden niet gesteld aan kerkelijke rechtsperso­nen, omdat de overheid zich niet wil bemoeien met de organisatie van kerken. Kerkgemeenschappen worden dus zonder meer als rechtspersonen erkend. Wel zei de in 1988 ingetrokken Wet op de Kerkgenootschappen dat kerkgenootschappen zich met hun kerkorde bekend moesten maken bij de minister van justitie, maar dat had niets te maken met rechtspersoonlijkheid. Bovendien werd de lijst van kerkgenootschappen op het ministerie van justitie al lang niet meer bijgehouden.
Kerkelijke rechtspersonen bekleden temidden van de publiekrech­telijke rechtspersonen (rijk, provincie, gemeente, waterschap e.a.) en de privaatrechtelijke rechtspersonen (vereniging, NV, BV, stichting) een eigen plaats. Voor deelname aan het burgerrechtelijk rechtsver­keer, zodat zij kunnen kopen, verkopen, erfenissen en legaten aan­vaarden, contracten sluiten, personen in dienst nemen enz., zullen zij van geval tot geval moeten kunnen aantonen: a. dat zij een kerke­lijke rechtspersoon zijn; b. dat het besluit om de voorgenomen zaak te doen door het bevoegde orgaan binnen de rechtspersoon en rechtsgeldig is genomen; c. dat de zich als vertegenwoordigers van de rechtspersoon aandienende personen werkelijk bevoegd zijn om namens de rechtspersoon te handelen.
In geval van een hervormde gemeente of een rooms-katholieke parochie dient er voor het verrichten van rechtshandelingen van ver­mogensrechtelijke aard ook nog toestemming te zijn van een hoger orgaan binnen de kerkgemeenschap.

 

Het recht van de kerk en het recht van de staat

Tenslotte wil ik iets zeggen over het onderscheid en de verwantschap tussen het recht van de kerk en het recht van de staat. Beide maken zij als kerkelijk recht of als staatsrecht, met o.m. het burgerlijk recht, het arbeidsrecht, het volkenrecht, deel uit van wat wij in het alge­meen recht noemen.
Intern spreken wij in de kerk over kerkrecht. Ter onderscheiding van andere rechtsgebieden spreken wij over kerkelijk recht. Kerk-recht/kerkelijk recht is de door de kerk zelf gegeven ordening aan haar leven en werken.
Wat is nu temidden van de andere rechtsgebieden het eigene van het kerkelijk recht?
Het bijzondere van het kerkelijk recht is in de eerste plaats gege­ven met het object daarvan: de kerk. En de kerk is temidden van alle andere samenlevingsvormen uniek. De kerk is niet alleen een gemeen­schap van gelovigen, ze is zelf als verschijningsvorm object van ge­loof. En de wijze waarop de gelovigen die samen de kerk vormen, de kerk zien, komt tot uitdrukking in de wijze waarop de kerk zich­zelf organiseert. Daarom is de kerkorde onlosmakelijk verbonden aan de confessie.
Daarmee is t.o.v. de staat de souvereiniteit van de kerk gegeven. Er mag geen andere macht boven haar zijn die haar de wet leest dan alleen Christus, die zijn kerk regeert door zijn Geest en Woord. Daaruit volgt, dat in materiële zin de bron van het recht van de kerk een andere is dan die van het recht van de staat. Zonder te ontkennen dat ook het recht van de staat gebonden is aan hogere, meta-juridische normen, wil ik toch stellen dat, althans in een democratisch geregeerd land als Nederland, bepalend voor het staatsrecht is wat de bevolking van het land als recht ziet en ervaart. Verandering van het rechtsge­voel onder de burgers van de staat zal uiteindelijk leiden tot verande­ring van de inrichting van de staat. In dat opzicht is de staat autonoom. Zo gezien is de kerk heteronoom, omdat de bron van het recht van de kerk niet ligt in de kerk zelf maar in Gods Woord als enige regel voor geloof en leven.
Daar komt nog iets bij. We zien dat zowel in de kerk als daarbui­ten het geldende recht en de loop daarvan niet ideaal zijn. Er moet nogal eens wat beslist of door de vingers gezien worden om der zonde wil. Verschil is dat daarbij op de gelovigen in de kerk een ander beroep gedaan kan worden dan op de burgers van de staat. Dat bete­kent dat in de kerk in bepaalde gevallen een andere rechtspleging moge­lijk is dan daarbuiten. Vergelijk het tuchtrecht van de kerk maar eens met het strafrecht van de staat. Dat heeft te maken met de bron waaruit dat tuchtrecht of dat strafrecht opwelt. Het heeft ook te ma­ken met het doel van het recht van de kerk of het recht van de staat. Het recht van de staat dient immers primair de vrede en de orde in de samenleving van het land. Het recht van de kerk dient primair de verkondiging van het Evangelie in de kerk en in de wereld.
Betekent dat nu dat in de kerk recht iets anders inhoudt dan in de staat? Dat kan niet waar zijn. Wat in de kerk recht is, kan buiten de kerk geen onrecht wezen en wat in de kerk onrecht is, kan buiten de kerk geen recht zijn.
Want boven het onderscheid uit gaat de verwantschap. Immers aan het begin van alle recht staat het Woord van God, die orde schiep op een woeste en ledige aarde en scheiding maakte tussen licht en duisternis.
Wie die verwantschap over het hoofd ziet, komt tot een twee-rijken-leer, waarbij het wereldlijke karakter van de kerk en het geestelijke karakter van de staat worden verdoezeld en waarbij wordt vergeten dat beide rijken staan onder één Heer. Daarom is het legitiem als de kerk voor haar recht figuren ontleent aan andere rechtsgebieden en het recht van de kerk als christelijk gebod gelding krijgt in staat en maatschappij.
In wezen is er dan ook geen werkelijke scheiding tussen kerkelijk recht en ander recht, omdat het allemaal teruggaat op Gods schep­pingswoord dat, vandaag gesproken in kerk en staat, heenreikt naar de herschepping van een gevallen wereld.

De Hoge Raad

 

De Hoge Raad der Nederlanden is de hoogste rechter in Nederland in civiele zaken, strafzaken en belastingzaken. Hij is dat ook voor Aruba, Curaçao, Sint Maarten en Bonaire, Saba en Sint Eustatius. De Hoge Raad is geen derde instantie maar cassatierechter. Dat betekent dat de Hoge Raad beoordeelt of de feitenrechter het recht goed heeft uitgelegd en toegepast.

 

In cassatie gaan is beroep aantekenen bij het hoogste rechtsprekend orgaan tegen een uitspraak van een lagere rechter. Dit orgaan houdt dan alleen rekening met de wijze waarop de lagere rechter de wet heeft toegepast. Een cassatierechter treedt dus niet in beoordeling van de feiten zelf.

 

HOGE RAAD GAAT ZICH UITLATEN OVER HET BEGINSEL OPENBAARHEID RECHTSPRAAK

Zijn rechtbanken verplicht om op verzoek informatie te verstrekken of tussen partijen een bepaalde procedure aanhangig is? Sommige griffies vertellen dat zonder problemen, andere griffies weigeren die informatie te verstrekken. Zo’n weigering is in strijd met de openbaarheid van rechtspraak, zeggen advocaten van Taylor Wessing, die hierover een uitspraak van de Hoge Raad wensen.

 

 

Hoe is dit verhaal begonnen?

David Mulder

David Mulder, advocaat bij Taylor Wessing: “In 2019 is ons kantoor een verzetschriftprocedure gestart tegen de griffier van de rechtbank Den Haag. Wij wilden weten of tussen bepaalde partijen een procedure aanhangig was, maar daarover werd geen informatie verstrekt – zelfs niet over de vraag of en wanneer een mondelinge behandeling zou plaatsvinden. Dat is naar onze mening in strijd met het beginsel van openbaarheid van de rechtspraak. Ons kantoor houdt zich onder andere bezig met advisering op het gebied van intellectueel eigendomsrecht en dan is het bijvoorbeeld regelmatig van belang om lopende octrooiprocedures van andere partijen te volgen. Maar bij sommige rechtbanken en gerechtshoven lukt dat dus niet.”

Wat deed u tegen die weigering van de griffier?

“Nadat we hier al een paar keer eerder tegenaan waren gelopen, zijn we uiteindelijk in september 2019 in verzet gegaan. Die procedure leidde op 26 november 2019 tot een beschikking van de voorzieningenrechter van de rechtbank Den Haag. Die verklaarde ons verzet ongegrond omdat de griffier daags voor de zitting in deze zaak alsnog de gevraagde informatie verstrekte.”

Dus u was nog niet verder.

“We juichten de herziene beslissing van de griffier van de rechtbank Den Haag natuurlijk toe. Tegelijkertijd merkten we dat dit landelijk speelt, reden waarom we hebben doorgezet. Alle rechtbanken en gerechtshoven lijken er namelijk een verschillend beleid op na te houden. Uit een steekproef bleek dat waar de ene rechtbank of gerechtshof zonder probleem de informatie verstrekt – telefonisch of per e-mail – andere rechtbanken en gerechtshoven weigeren dat te doen. Sommige gerechten willen zelfs die weigering niet schriftelijk bevestigen, waardoor het lastig kan zijn tegen die weigering in verzet te gaan. In één geval was het bovendien de rolrechter die op het verzoek besloot de informatie te weigeren in plaats van de griffier.”

Wat was de vervolgstap?

“Eerst stuurden we een ingezonden brief naar Boek9.nl en IE-Forum.nl. Verder werd aan deze kwestie aandacht besteed in het vakblad Intellectuele Eigendom & Reclamerecht (IER 2020/1) door Frank Eijsvogels, octrooiadvocaat bij Hoyng Rokh Monegier. In april 2020 hebben we tot slot de uitspraak van de voorzieningenrechter toegezonden aan de Commissie cassatie in het belang der wet.”

Waarom?

“Er is veel onduidelijk rondom de vraag of griffies van de gerechten informatie over lopende procedures moeten verstrekken en wat je kunt doen tegen een eventuele weigering. Wij hebben betoogd dat de griffier gehouden is deze informatie te verstrekken op grond van artikel 838 Rv. Dit artikel maakt echter niet duidelijk bij welke rechter je terecht kunt in geval dit wordt geweigerd. In de literatuur is betoogd dat het dan voor de hand ligt aansluiting te zoeken bij artikel 29 lid 6 Rv. Aangenomen dat dit klopt, bepaalt artikel 29 lid 7 Rv evenwel dat er geen beroep open staat tegen een beslissing van de voorzieningenrechter. Zonder cassatie in het belang der wet zal deze kwestie de Hoge Raad niet snel kunnen bereiken. De enige optie die wij daarvoor zien is dat de griffie van de Hoge Raad zelf weigert informatie over aanhangige procedures te verstrekken, maar deze geeft deze informatie juist wel, of dat er prejudiciële vragen worden gesteld aan de Hoge Raad.”

Wat was de reactie van die Commissie?

“De Commissie liet weten dat de uitspraak in onze zaak van 2019 niet in aanmerking komt voor cassatie in het belang der wet, maar wel een uitspraak van dezelfde rechtbank van 27 september 2012 waarin ook werd geweigerd de gevraagde informatie te verstrekken. Er is dus besloten om de kwestie voor te dragen bij de procureur-generaal bij de Hoge Raad voor het instellen van een cassatie in het belang der wet. Daar zijn we blij mee. Taylor Wessing is niet het enige kantoor dat hiermee te maken heeft. Het is een kwestie waar veel collega’s in de praktijk regelmatig tegenaan lopen als zij voor hun cliënten informeren over lopende procedures van anderen. Hopelijk neemt de procureur-generaal dan ook het advies van de Commissie over.”

Rechter: OM kan onschendbare ambtenaar toch vervolgen

De strafrechtelijke onschendbaarheid van ambtenaren staat op losse schroeven. Het OM kan ambtenaren wel degelijk vervolgen. Dat is het oordeel van het gerechtshof Den Haag in een door twee toeslagenouders aangespannen procedure.

Advocaat Anis Boumanjal stond de twee ouders bij. "Het OM heeft heel lang volgehouden dat zolang een ambtenaar niet handelt uit eigen gewin, en dus eigenlijk in het belang van de overheidsdienst, hij niet strafbaar is. Daar is nu een streep door getrokken."

Er zal wel een ernstige mate van verwijtbaarheid moeten zijn. Schending van fundamentele rechten bijvoorbeeld.

Het OM kon ambtenaren alleen vervolgen als er sprake was van een ambtsmisdrijf waarbij er sprake is van persoonlijk gewin bij een bepaalde overtreding. Bijvoorbeeld het aannemen van steekpenningen om iets door de vingers te zien. Het Hof in Den Haag vindt nu dat het OM ook andere zaken moet onderzoeken, als daar aanleiding voor is.

De advocaat benadrukt dat het oordeel van de rechter gaat over ambtenaren die buiten hun boekje treden, maar zonder daar persoonlijk beter van te worden. "Dus zelfstandig, eigenhandig mensen op een fraudelijst zetten en dan vervolgens zeggen dat ze dat deden in het belang van de fraudebestrijding." Volgens Boumanjal is dat in de Toeslagenaffaire gebeurd.

Hij noemt ambtenaren die in de Toeslagenaffaire eigenhandig mensen selecteerden op basis van hun etnische achtergrond. "Als je dat ook nog eens zelfstandig doet én moedwillig, dan ben je wat mij betreft niet een ambtenaar die te goeder trouw is, maar één die gewoon kwaad in de zin heeft. Daar zit het verschil."

Voorzichtiger
Het is nog de vraag wat dit precies voor ambtenaren gaat betekenen, denkt Herman Bröring, hoogleraar bestuursrecht aan de Rijksuniversiteit Groningen. "Er zal wel een ernstige mate van verwijtbaarheid moeten zijn. Schending van fundamentele rechten bijvoorbeeld."

Daarom wil hij het oordeel van het Hof niet veel breder trekken. "Die stap moet je denk ik nu niet zetten, want de Toeslagenaffaire is ook wel weer een heel bijzondere casus."

Er is volgens hem al langer discussie over de immuniteit van ambtenaren. Ook een deel van de Tweede Kamer zou voor afschaffing zijn. Maar tegenstanders vrezen dat ambtenaren veel te voorzichtig zullen worden.

Bröing legt uit dat een ambtenaar dan wel in dienst is van de overheid, maar ook zelf initiatieven moet kunnen nemen. "Als ze daarbij niet goed uitkijken, gaat het best ver om dat dan in de strafrechtelijke sfeer te trekken."

Goede voorbeeld
Bas van Weegberg van vakbond FNV is niet meteen geschrokken van het oordeel. Strafrechtelijke vervolging is een sluitstuk, vindt hij. "Er gaat natuurlijk al een heleboel mis als je daar uiteindelijk terechtkomt."

Als ander voorbeeld noemt hij de Dienst Uitvoering Onderwijs (DUO), die studenten met een migratieachtergrond opvallend vaak beschuldigde van fraude met studiefinanciering.

Hij ziet vooral een rol voor de overheid als werkgever. "De politiek moet beleid maken dat past binnen de rechtsstaat. Beleid dat niet discrimineert of racistisch is. De overheid als werkgever heeft een belangrijke rol om haar eigen mensen te beschermen, maar ook het goede voorbeeld te geven."

Voor de twee Toeslagenouders is het oordeel van de rechter te laat. Hun aangifte heeft betrekking op discriminatie in 2008, 2013 en 2014. Discriminatie verjaart na zes jaar. Ook zag de rechter te weinig aanknopingspunten voor een strafvervolging van ambtenaren van de Belastingdienst.

Dat was slecht nieuws voor de ouders, zegt hun advocaat Boumanjal. "Helaas leidt het oordeel niet tot een daadwerkelijk vervolging in dit concrete geval. Maar zij hebben wel de weg geplaveid voor de toekomstige generatie. En dat is echt de verdienste van deze twee aangevers."

Eed en belofte

 

U legt met de eed of belofte een verklaring af over uw functievervulling als ambtenaar. De achterliggende gedachte is dat u hiermee uitspreekt dat u zich bewust bent van uw bijzondere positie in de samenleving. U bent verplicht om de eed of belofte af te leggen.

 

Als ambtenaar hoort u zich net als iedere burger aan de wet te houden. Met het afleggen van de eed of belofte benadrukt u nog eens dat u dit ook werkelijk zult doen. Bovendien verklaart u dat u een onkreukbare en betrouwbare ambtenaar zult zijn. U ondertekent ook een formulier waarin de regels staan waaraan u zich zult houden.

Met de eed of belofte zweert of belooft u het volgende:

  • 'dat ik trouw zal zijn aan de Koning en dat ik de Grondwet en alle overige wetten van ons land zal eerbiedigen'
  • 'dat ik noch direct, noch indirect in welke vorm dan ook valse informatie heb verstrekt in verband met het verkrijgen van mijn dienstverband'
  • 'dat ik tot het verkrijgen van mijn dienstverband aan niemand iets heb geschonken of beloofd en dat ik dit ook niet zal gaan doen'
  • 'dat ik tot het verkrijgen van mijn dienstverband van niemand giften heb aanvaard en aan niemand beloften heb gedaan en dat ik dit ook niet zal gaan doen'
  • 'dat ik plichtsgetrouw en nauwgezet de mij opgedragen taken zal vervullen en zaken die mij uit hoofde van mijn functie vertrouwelijk ter kennis komen of waarvan ik het vertrouwelijke karakter moet inzien, geheim zal houden voor anderen dan die personen aan wie ik ambtshalve tot mededeling verplicht ben'
  • 'dat ik mij zal gedragen zoals een goed ambtenaar betaamt, dat ik zorgvuldig, onkreukbaar en betrouwbaar zal zijn en dat ik niets zal doen dat het aanzien van het ambt zal schaden.'

 

De eed of belofte wordt zo snel mogelijk, in ieder geval binnen 3 maanden na indiensttreding, afgenomen bij medewerkers met een vast of tijdelijk dienstverband. U ontvangt hiervoor een uitnodiging. U kunt vooraf uw voorkeur aangeven voor de eed of de belofte.

Als u al eerder in het kader van een dienstverband bij de Rijksoverheid de eed of belofte heeft afgelegd, hoeft u dat niet nog een keer te doen. U moet de eed of belofte wel opnieuw afleggen als het betreffende formulier ontbreekt in uw personeelsdossier.
